start by recognizing our Unified Police Chief who is here with us tonight, Jason Mazarin. He's the top dog of Unified Police. So 00:00:17
Chief, we're honored to have you here tonight for a special presentation. 00:00:24
And we're in a minute going to we've got, I got to get going because we got 15 or 20 people lined up to speak about Chief Thomas, 00:00:32
who just retired. So we'll be here till probably 8. 00:00:38
He won't be here, but they'll be speaking. He'll leave. 00:00:44
But anyway, we're going to we just want to recognize Chief Thomas and I just want to say personally, Chief, what an honor it's 00:00:47
been to work with you. He's retired, I think after 30 or retired yesterday, I believe after 30 years of of service to this 00:00:54
community and to UPD has been a great friend to the city of Holiday. 00:01:01
We're very sorry to see you go, but we're very happy that you get to to enjoy a well earned retirement or whatever it is you're 00:01:09
going to do when you're not doing police work now. 00:01:15
And he's graciously agreed to start with the pledge. We always start with the pledge. We're going to have Chief Thomas lead us in 00:01:21
the pledge and then we'll take it from there. Chief Hoyle will take it from there. 00:01:25

Chief, here with me for a minute. I'm going to start. I've got a couple of awards to give out tonight. 00:01:57
Start with Chief Thomas, because I know he might have to bust out of here and run up to White City City Council tonight. So I'm 00:02:04
going to just start with this. This isn't something that we normally do when somebody retires to bring another chief over here, 00:02:10
but there's there's a little special circumstance that I wanted to recognize. Randy, sorry, I'm going to get choked up on this. 00:02:15
Randy and I got hired together. 00:02:20
28 years ago here and I've, I've kind of followed him around my whole career. We started together out in West Patrol. He went to 00:02:27
the motorcycle squad. I went to the motorcycle squad there after. 00:02:32
He went to the SWAT team, I went to the SWAT team, and then, you know, at one point there was a little separation there and then 00:02:38
he went to canine and I went to Homicide and did some different things. But then he was over our dispatch center. A short time 00:02:44
later I was over our dispatch center. He became the chief in Midvale. And then about a year later, I was honored to be your chief 00:02:49
up here. But the one thing about Randy that I wanted to recognize is. 00:02:55
Throughout my career, he's always been that mentor to me. He's always been somebody that's taken me under his wing and all these 00:03:01
assignments that I've come in underneath him and supported me and he's been a really dear friend. Even though Randy, you've had a 00:03:07
lot of seniority and other assignments, I still have seniority over you at Bear Lake. So keep that. Don't let free at that, but 00:03:12
even at that when it comes to holiday here. 00:03:17
From the minute that I became your chief, he brought me up to his office and said, hey, look, Justin, here's some things that 00:03:25
you're going to want to do to really provide reports to the city. 00:03:28
Information they're going to want and it and it didn't stop there throughout the last five years as the mayor and Gina would even 00:03:32
know whenever I've been out of town and Tyler's been out of town. Randy's been the one that's taken taken the watch over holiday 00:03:38
city for you and never let things miss a beat up here. Many times throughout the years that I've been up here we've needed help 00:03:44
with search warrants additional detectives and every time I've called him is is there's been no hesitation and he sent detectives 00:03:50
from Midvale to come up and help. 00:03:56
And search warrants have been here and some of you may even recall a couple years ago we had a very large property theft case that 00:04:02
was going on with over $1,000,000 in recovered property. We had several search warrants going on simultaneously and I called Randy 00:04:07
for help and not only did he send help, but he came personally. He's always been one that's been a friend to Holiday City. He's 00:04:12
been one that I've been able to call regularly and ask for advice. We bounce ideas off each other all the time and he's going to 00:04:17
truly be missed. So with that. 00:04:22
Because of all the work and effort that he's done for us in the precinct, in the city. 00:04:28
I'm presenting him with the sorry, it makes a lot of noise. The division commander award, which is something that is a precinct 00:04:33
chief you can give out to people for special recognition that they deserve, which Randy does. Normally this pin goes on your 00:04:38
uniform, but since I wasn't able to talk him out of staying, we put it on a plaque to present to him for all of his efforts and 00:04:44
and contributions to the city of Holiday. So congratulations. 00:04:50
In addition, the mayor wanted me to give you his last one that he had, but this is. 00:05:07

And ask for advice and seeks different opinions and things like that. And Justin is a person that does that. I can't tell you how 00:05:42
many conversations I had where he says, hey, I was just talking to Randy and I was just talking to Randy. I was talking to Randy. 00:05:48
And I just want the council of mayor to know that, you know, although Chief Thomas was assigned elsewhere, he has done a lot to 00:05:54
support this city, this great city of holiday and. 00:06:00
Has been a phenomenal leader and is very well respected in the organization and has been a good friend of all of us that are here 00:06:08
and he will be missed so. 00:06:12

area. I love the culture over here and I what I really love is the UPD model where we can share with each other, you know, limited 00:07:04
resources. We can shift resources and you need help, we'll be there. I need help. Same thing so and we've, you know, Justin and I, 00:07:11
I never really tracked on how we've kind of our careers have crossed paths, but we he's always been a wingman to me and. 00:07:18

I keep on saying I got a different, you know, different profession, but at this point, I'm not going anywhere. I'm just doing a 00:07:27
different thing. So I hope we can still have those conversations and bounce ideas off each other. And I appreciate your time. I'm 00:07:32

These two are phenomenal employees, phenomenal officers and continually go above and beyond to serve the city. And So what I want 00:08:22
to present them because of certain instances, I'll read you the certificates that are here. They receive an incentive award, which 00:08:29
not only do they get this certificate, but they get $100 incentive on their check for going above and beyond. 00:08:35
And so I'll just read you what, sorry. 00:08:42
To an area hospital as they were on scene, the child's condition improved so well that he did not even need to go by ambulance. 00:09:14
They released him to his family to go in a personal vehicle. It was later determined the child had been underwater for over 2 00:09:20
minutes. Detectives on theirs to be committed for his quick actions and helping this child begin to breathe again. 00:09:25
Detectives on there always goes above and beyond to help people in need and is and that is no different. He's an asset to the 00:09:31
Unified Police Department, the city of holiday and the community serves. He he as you know, he, he's our mental health detective 00:09:37
here. And and this is just one example of about 1000 that he does every single day of going above and beyond to help other people. 00:09:43
And so we wanted to recognize him for helping save the life of a child. Correct. Congratulations. 00:09:49

And this is just very common of her, as you know, we've recognized her several times here, but this is this is the work she does 00:12:30
also every day. She just doesn't stop. And it doesn't matter where she's at. She continually gives to serve the community. And 00:12:35

And I'm here before you today just with to propose something and that I read the public hearing to propose text amendment and I 00:17:45
would like the Council to consider. 00:17:50
The possibility? 00:17:56
Of making a text amendment to the PO zone. 00:17:59
And this is the perfect time because you're looking at it right now. 00:18:04
To be able to add business uses to the PO zone for. 00:18:08
Businesses that are for the opposite buildings that are long Mary Holiday Rd. 00:18:16
My building has been there forever. It was originally the Mountain Fuel building and then it was remodeled and adapted and it's 00:18:20
now 10,000 square foot office building and I haven't I'm full. I have a number of tenants that are in there and recently I just 00:18:27
found out that. 00:18:33
Like a massage therapist person or someone who does Botox or someone who does anything basically that touches somebody else is not 00:18:41
allowed in that zone. 00:18:47
Whereas it was years ago and so I've went to. 00:18:55
Meeting with Jonathan and with Carrie on September 17th and I was the only person that showed up. 00:19:02
And we talked about what I can do, and my options are to hold a neighborhood meeting and to give the neighborhood input and then 00:19:10
come before the Planning Commission, then come back before you just to get it rezoned. There are a number of buildings and I don't 00:19:18
know if you can pull. 00:19:25
That I thought that Carrie was going to be here today and she could pull that up and show you just how vast it is. There's only 00:19:32
just a few buildings along there that have gone through this rezoning thing, but if you could change it and do a text amendment. 00:19:40
Or resolution, amendment, or however the city attorney thinks you can handle that so that all of these neighbors on Murray, 500 00:19:49
feet off Murray Holiday Rd. don't have to be notified and notified and notified as all these businesses go, buildings go one at a 00:19:55

amendments to allow short term rentals as a conditional use in the PO zone. 00:21:26

Inclusion in the packet that has the has a staff report that's been prepared that the council, the council has reviewed as well as 00:21:47
documents from the public hearing with the Planning Commission on this particular item. So we'll start with John Tier link. And 00:21:53
John, if you just want to kind of give us an overview and see if the council has any questions. And then we'll see if the 00:22:00
applicant wants to address the council and then we'll work our way into a public hearing. 00:22:06

John Terlington, Community and Economic Development Director. Application before you tonight is a legislative request. 00:22:16
By an applicant owning property on Highland Drive in about 6400 S. 00:22:22
The request currently is to have property that's currently zoned PEO Professional office. 00:22:29
To include short term rentals. 00:22:36
There is a staff report in there that's pretty detailed, but I'll hit some high points. Primarily, this property was rezoned 00:22:39
recently from RM. 00:22:43
RM Zone is one of the couple of handful of zones in the city that does allow already short term rentals. 00:22:48
That use in 2018. 00:22:57
Removing all of the office allowed office uses in the room zone. The room zone was a mixed-use zone. 00:23:00
To create its own professional office on, the council requested staff to study that and propose a new zone, which was primarily 00:23:07
office uses. 00:23:11
And greatly expanded the number of types of businesses that can go into that zone. 00:23:16
This property is rezoned to PO. However, the STR allowance, the short term rental allowance was not something that was considered 00:23:23
to move over with that change. 00:23:28
So specifically this is being asked to be applied for one location in particular. However, a text amendment would be something 00:23:33
that would be applied to all PO zones as a use so. 00:23:39
That would have to be taken into consideration. 00:23:46
Other than that, maybe answering questions that might help get to the root of any concerns you may have or questions you might 00:23:50
have. 00:23:54
So could you speak maybe to initially when the STR what? 00:24:00
What was the do you recall the rationale at the time of the creation of the PO zone as to why the STR didn't move over from RM? 00:24:04
The directive from the council at the time in 2018 was to create a zone that was office centered. 00:24:11
Professional office centered. 00:24:19
The Planning Commission had several meetings on what types of uses uses should be allowed in that new professional office zone. 00:24:21
That type of use a residential type of use. 00:24:29
Short stay was not something that was considered to move over. Got it. 00:24:33
When we talked about this before the briefing, but. 00:24:38
I had noted that the. 00:24:43
PO zone actually does not have any residential uses, let alone short term. 00:24:46
Rental Residential. 00:24:52
The only exception being in a pud. 00:24:55
And tell me if I'm stating this correctly or incorrectly. Except for the if you have a PUD that has mixed-use. 00:24:59
But that part of the code specifically excludes short term rentals, so it seemed like there was. This was not a situation of an 00:25:05
oversight, but rather a specific. 00:25:11
The thought had gone into the exclusion as opposed to being an oversight. 00:25:17
And I don't know what that reasoning was, but it appears as I read the code that there was reasoning there as opposed to being an 00:25:24
oversight. 00:25:28
Would there be a way we could like look back and see if there's a record of what that reasoning would be? 00:25:34
Well, definitely you would have minutes from those meetings and from both Planning Commission and City Council. 00:25:41
Whether or not the. 00:25:48
That was a long time ago. It's possible that they would be happy to talk about that directly. Sure, we can. Yeah, you can take a 00:25:51
look at that for sure. 00:25:54
So long term rentals are not allowed in the PO zone. 00:25:59
They would be under the mixed-use planned unit development. They're allowed as a conditional use permit which has been approved at 00:26:03
this site. So a long term rental could so it's a live work type situation where someone could live upstairs and work in the space 00:26:10
below. That was sort of the idea that it could be allowed a short term rental was was something that wasn't necessarily included, 00:26:17
but a long term rental code. Yeah, I mean so totally different like. 00:26:24
Somebody has an apartment or a home above their office and or rents to somebody that has an office as opposed to. 00:26:32
We want to turn it into an Airbnb. 00:26:41
Yeah, essentially. 00:26:44

And so as I understand it that the code then requires that the. 00:26:47
There's a connection or a link between the. 00:26:52
Professional use and the person living in the long term rental not directly, but that would have been the idea is that it's sort 00:26:56
of to address even if an affordability notion. 00:27:02
That someone could live above the space that they work at. 00:27:09
And have that option available in throughout the city. 00:27:12
But requiring them to be the one that lives there and also runs the office was not something that was required. 00:27:18
And I think that's one of the reasons why it's proposed as condition. 00:27:24
All short term rental. 00:27:29
Approvals in the city or conditional approvals granted by the Planning Commission, which in this case is a land use authority. 00:27:31
So that they can assess impact, you know, based on the specific circumstances, right. Yeah. 00:27:38
And this one specifically, this is one that's just north of the Fairfield Inn, is that correct? 00:27:46
That white colonial looking. 00:27:52

Did the applicant want to address the Council? 00:28:05

So I want to give the Council a little bit of understanding of how we got to where. 00:28:21
So I'll do my best of giving you the explanation of what the zones are and and why it is the PO is what we want. So this 00:28:26
particular piece of property is a little bit different. It's in the Highland Dr. general use plan, the Highland Dr. plan. If you 00:28:31
remember when we did the rezoning, there were some public comment the neighborhood did not want this to be commercial, which is 00:28:37
what it was supposed to be C2. 00:28:42
C2 would allow conditionally the short term rentals the. 00:28:49
The purpose of this is that for my parents to be able to live in this building for the remainder of their lives, they've taken the 00:28:56
top floor of that or the planets take the top floor of that. We're working through the building Commission, building inspectors. 00:29:02
But to move that into their apartment, they separated into two apartments so that the plans have to be two apartment there's and a 00:29:09
secondary 1 because it's bigger than what they need in the room zone. 00:29:16

Entire building could have been turned into residential or the entire building could have been turned into commercial or remained 00:29:25
as commercial as it was. The PO zone when that was created in 2018, gave the ability to create these offices. But to have the live 00:29:31
work situation, kind of the update of the code as society has gotten to that point, has gotten to the point where we like having 00:29:37
commercial uses on the main floor, residential uses above that. 00:29:43
As for the PO zone, what seems to be have designed to have been done? 00:29:50
Is it creates this where we can have the live work under a conditional use permit that's been obtained for this particular 00:29:54
property, for any property that would want to have the conditional use of residence and even potentially the conditional use of a? 00:30:01
Short term rentals. It would be a 2 step process, just as the applicant here has undergone. It's a 2 step process. 00:30:10
What they would like is to have the permit, the short term rentals permitted here. If the council will remember or recall both 00:30:16
the, I believe it's RM and R2 zoning permit short term rentals. The CN, excuse me, the C2 permit short term rentals. PEO seems to 00:30:22
be a bit of an outlier here. 00:30:28
And we think what we're asking the council to do is to correct this as an outlier to allow the conditional use of short term 00:30:36
rentals in this PO zone, Certainly something that can be looked at on a case by case basis, but something that must be. 00:30:43
The statute of let, the council must change the text of the PO zone in order to allow it. I would like to remind the council that 00:30:52
there the Planning Commission, there's a little bit of a procedural irregularity in that although there was a negative 00:30:58
recommendation forwarded from the Planning Commission, the applicant was not given notice of the hearing. We've gone, we've 00:31:04
listened to the minutes into the audio of the hearing. There's one of the members of the Planning Commission that's very much in 00:31:10
favor and says this is what needs to happen. 00:31:16
Another member of the Planning Commission that said. Why is the applicant not here? Another member of the Planning Commission that 00:31:22
said. 00:31:26
This person came and rezoned this to PO. They're now here. They came and asked for conditional use permit. Now they're asking for 00:31:31
a short term rental. What are they doing? I think we're we ought to just vote no. We have two people on the Planning Commission, I 00:31:38
believe it was 2 that were largely against allowing the short term rentals here and allowing the short term rentals anywhere. 00:31:44
In the PIO zone, and I think that reflects somewhat of the political reality that we live in is that there are a lot of people 00:31:51
that do not want short term rentals to be anywhere I. 00:31:56
If we look at the if the Council looks at the staff report, the Council should consider three factors determining whether to 00:32:01
approve or deny the proposed amendment. The first would be whether the proposed amendment is consistent consistent with the goals, 00:32:08
objectives and policies of the cities general plan. The second would be whether the proposed amendment is harmonious with the 00:32:15
overall character of the existing development in the vicinity of the in the vicinity of the subject property. And 3rd. 00:32:22
The extent to which the proposed amendment may adversely affect abutting properties. 00:32:29
Adequacy of facilities and services intended to serve the subject property such as roadways, parks, recreational facilities, etc. 00:32:33
If we look at factor number one, I think the Highland Dr. Master plan adequately addresses this. It has an in segment C of the 00:32:42
Highland Dr. Master plan. 00:32:45
And it's primarily zoned for commercial purposes. As I noted earlier, the reason this property was rezoned to PIO as opposed to 00:32:50
the C2, which is what the master plan called for, was because the community did not want C2 specifically because they had problems 00:32:56
with the property just to the north of that strip mall. And they they were very much against having this property rezoned to the 00:33:01
the C2, which is again why the applicant wanted PL. because for their purposes, they want to live here and rent the remainder of 00:33:07
it out. They do not have. 00:33:13
Another office there, although I think the intent is that they'll run some of their businesses out of a conference room on the 00:33:19
main floor, but it's not specifically, I guess, live work as we may generally look at that. 00:33:26
The. 00:33:34
The general plan discusses incorporating the mixed-use into the primarily commercial. 00:33:36
What we're supposed to do also with the PIO is create a buffer zone between the heavy commercial and the residential. 00:33:42
Allowing short term rentals here would do exactly that. It would actually lessen the impact of the commercial because, as noted in 00:33:50
the Council report, I. 00:33:53
So the commercial is used during the day, the short term rental is used, nobody's there during the day, it's used during the 00:33:59
night. So as opposed to having high volume use during the day and then no use at night, there'd be minimal use or less use during 00:34:03
the day and then minimal use at night. 00:34:07
I also would note that specifically next door to this property is the Fairfield Inn that was rezoned to Ord. 00:34:12
And so this property seems to be one particularly situated that would be appropriate for the council to look at, for the council 00:34:20
to be able to conditionally allow it if the council wanted to do that. We can't do that unless and until the PO zone gets amended. 00:34:26

There seem to be adequate facilities, pedestrian center, bus hub, other public transit options. The street size is one of the 00:34:38
things that the the council report talks about. The street sites here as well as everywhere else in the PO zone as well as 00:34:43
everywhere in the room zone. All the buildings are appropriately St. sized for the potential use of the short term rentals is 00:34:49
called out in the code. 00:34:54
Also one thing that I want the council to recognize is that as noted in the report to these buildings that are in the PO zone 00:35:03
generally are as I noted before have been the room. So they're either complete residential or complete office and the city has 00:35:09
made a point of trying to turn those into office buildings. Allowing some of that residential to remain will increase the buffer 00:35:15
zone that's there will allow. 00:35:21
The city to better plan. 00:35:28
Specifically, these soft buffer zones between the dense commercial that is noted in the general plan of often on that Highland Dr. 00:35:32
corridor and the residential that comes off of that. 00:35:38
With the second and third part of that, the. 00:35:50
And I think I've addressed the harmonious character of the existing development and the vicinity of this particular property. And 00:35:54
also with all of the RM zone and all of the PO zone, we've reached out there. As noted in the Council report, there are presently 00:36:01
8 properties in the PO Zone. Of those, we've submitted letters on behalf of, I believe. 00:36:07
Five of those property owners. 00:36:14
The fifth one, Mr. Ensign, who owns. 00:36:18
2225 Holiday LLC asked us to tell the council that he supports short term rentals to be added to the PO zone as a conditional use. 00:36:23
We didn't go through and pull all of the individuals that owned the RM zoning. I believe there were 36 or 38 of those. 00:36:31
But we think they are likely to be in favor because it allows the additional uses in the what amount to less use of these 00:36:40
properties, less severe use than purely an office use would dictate or purely residential use would dictate. And it seems to 00:36:45
further the the city's goal of the general plan. And then third, the extent to which the amendment, the proposed amendment may 00:36:51
adversely affect any abutting properties, the adequacy facilities and services such as roadways, parks, recreational facilities, 00:36:57
police and Fire Protection and etcetera. 00:37:02
And I think all of that is effectively done by making sure that these types of properties that would be in the in the PO zone or 00:37:09
the RM zone, which would potentially be rezoned to PO are wide enough. There's simply no negative. 00:37:16
Potentiality of allowing the PO zone in this text amendment, and I'll note that although the council report gives a negative 00:37:25
recommendation, it doesn't say you shouldn't ever do it. It says, let's look at this again in 2025 when we redo the entire general 00:37:31
plan, which is part of what we heard when we came in with the rezoning application. Well, this is supposed to be C2, but maybe 00:37:37
this should really not be C2, maybe should really go to PL. 00:37:42
To simply kick the can down the road I think is not the appropriate thing to do here. What we're asking is that the council be 00:37:49
given the discretion to allow these properties to be short term rentals if there's an investor such as as the owners of this 00:37:56
property that want to turn this into the kind of the next generation of properties that have the mixed-use. 00:38:03

Two of the bills that were passed in that session made some changes to the Community Renewable Energy Agency. 00:44:31
Law, one of which is. 00:44:41
Municipalities no longer have to have made that resolution that we made back in 2019, and that opens up the possibility of new 00:44:45
municipalities joining the program. Now Mill Creek has done so. Excuse me, not Mill Creek. 00:44:55
Midvale knew there was an M in there somewhere. Midvale. Midvale is now going to be a participating community. 00:45:08
And because the original utility agreement listed the names of all of the participating municipalities, we had to change that. We 00:45:17
also updated names for currents and immigration Canyon from Township to city. There was another bill that changed the. 00:45:27
That supposedly updated renewable to clean and there I know people who don't agree with that, but that's not for tonight's debate. 00:45:39
Umm, so there are just some small tweaks. One of the things that thank goodness someone thought to put in this is that if there 00:45:50
are any more changes, we don't have to go through this signing process again. So you can all I can guarantee that you won't. We 00:45:59

have 3 items I wanted to present to council. The 1st news event I wanted to share is yesterday we had our official kickoff of the 00:48:22
general plan update under the leadership of John Tier Link. And you're going to get a full presentation on that project, including 00:48:28
the timeline that will proceed over the next year at your December meeting and. 00:48:35
Right now, the team's going to be working on getting a steering committee together. 00:48:42
Developing a community engagement plan and conducting an existing conditions and plans audit. So watch for more on that in 00:48:47
December. But Speaking of the general plan, there's a new grant program that's been established by the Department of Water 00:48:53
Resources. This is a grant that would help us satisfy the requirement that's now part of a general plan. 00:49:00
If you remember, we got a really generous grant from the WFRC to do our general plan update. But what this would do is give us 00:49:06
even additional funds. So Carrie Marsh is working on that application. It's due on October 24th. If there's no concerns about us 00:49:12
pursuing that, we will put in an application and hopefully get some more funds. 00:49:18
OK, registration for the National League of Cities, their 2025 Congressional city conference that's been held in Washington, DC, 00:49:25
is going to open in November. And we talked about this opportunity last spring as a way to build our relationship with the Utah 00:49:31
congressional delegation. And I just wanted to check in to see who on the council would possibly want to attend that. I can send 00:49:37
you more details via e-mail. High level, it's being held March 11th through the 13th. That's a Tuesday through Thursday, and we 00:49:43

find a program name that we can market and that we can use to describe all the different history elements that we have in the city 00:50:28

So the steering committee, as well as our project consultant and city staff came up with some options. So what I'm going to do is 00:50:40
just read you a couple of names. These are not final names, but I just wanted to get your reaction to some of the words and see if 00:50:46
there are words that you really like or words that are a no go. And this will just help us as we kind of finalize things. So the 00:50:52
first option is called Holiday Echoes a Living History. 00:50:58
And just an example with that name, the walk that we're doing in the park, Outback would be called Holiday Echoes Heritage Walk. 00:51:04
So that's one option or words. Another option is rooted together, a living museum. 00:51:11
And as another example, our walk could be called They're Rooted together walk or Rooted Together Heritage Walk. And what we're 00:51:18
trying to do is we know this is history, but we're trying to use words again that we can kind of say quicker and that we can start 00:51:24

going to just start with this. This isn't something that we normally do when somebody retires to bring another chief over here, 00:02:10
but there's there's a little special circumstance that I wanted to recognize. Randy, sorry, I'm going to get choked up on this. 00:02:15
Randy and I got hired together. 00:02:20
28 years ago here and I've, I've kind of followed him around my whole career. We started together out in West Patrol. He went to 00:02:27
the motorcycle squad. I went to the motorcycle squad there after. 00:02:32
He went to the SWAT team, I went to the SWAT team, and then, you know, at one point there was a little separation there and then 00:02:38
he went to canine and I went to Homicide and did some different things. But then he was over our dispatch center. A short time 00:02:44
later I was over our dispatch center. He became the chief in Midvale. And then about a year later, I was honored to be your chief 00:02:49
up here. But the one thing about Randy that I wanted to recognize is. 00:02:55
Throughout my career, he's always been that mentor to me. He's always been somebody that's taken me under his wing and all these 00:03:01
assignments that I've come in underneath him and supported me and he's been a really dear friend. Even though Randy, you've had a 00:03:07
lot of seniority and other assignments, I still have seniority over you at Bear Lake. So keep that. Don't let free at that, but 00:03:12
even at that when it comes to holiday here. 00:03:17
From the minute that I became your chief, he brought me up to his office and said, hey, look, Justin, here's some things that 00:03:25

applicant wants to address the council and then we'll work our way into a public hearing. 00:22:06

John Terlington, Community and Economic Development Director. Application before you tonight is a legislative request. 00:22:16
By an applicant owning property on Highland Drive in about 6400 S. 00:22:22
The request currently is to have property that's currently zoned PEO Professional office. 00:22:29
To include short term rentals. 00:22:36
There is a staff report in there that's pretty detailed, but I'll hit some high points. Primarily, this property was rezoned 00:22:39
recently from RM. 00:22:43
RM Zone is one of the couple of handful of zones in the city that does allow already short term rentals. 00:22:48
That use in 2018. 00:22:57
Removing all of the office allowed office uses in the room zone. The room zone was a mixed-use zone. 00:23:00
To create its own professional office on, the council requested staff to study that and propose a new zone, which was primarily 00:23:07
office uses. 00:23:11
And greatly expanded the number of types of businesses that can go into that zone. 00:23:16
This property is rezoned to PO. However, the STR allowance, the short term rental allowance was not something that was considered 00:23:23
to move over with that change. 00:23:28
So specifically this is being asked to be applied for one location in particular. However, a text amendment would be something 00:23:33
that would be applied to all PO zones as a use so. 00:23:39
That would have to be taken into consideration. 00:23:46
Other than that, maybe answering questions that might help get to the root of any concerns you may have or questions you might 00:23:50
have. 00:23:54
So could you speak maybe to initially when the STR what? 00:24:00
What was the do you recall the rationale at the time of the creation of the PO zone as to why the STR didn't move over from RM? 00:24:04
The directive from the council at the time in 2018 was to create a zone that was office centered. 00:24:11
Professional office centered. 00:24:19
The Planning Commission had several meetings on what types of uses uses should be allowed in that new professional office zone. 00:24:21
That type of use a residential type of use. 00:24:29
Short stay was not something that was considered to move over. Got it. 00:24:33
When we talked about this before the briefing, but. 00:24:38
I had noted that the. 00:24:43
PO zone actually does not have any residential uses, let alone short term. 00:24:46
Rental Residential. 00:24:52
The only exception being in a pud. 00:24:55
And tell me if I'm stating this correctly or incorrectly. Except for the if you have a PUD that has mixed-use. 00:24:59
But that part of the code specifically excludes short term rentals, so it seemed like there was. This was not a situation of an 00:25:05
oversight, but rather a specific. 00:25:11
The thought had gone into the exclusion as opposed to being an oversight. 00:25:17
And I don't know what that reasoning was, but it appears as I read the code that there was reasoning there as opposed to being an 00:25:24
oversight. 00:25:28
Would there be a way we could like look back and see if there's a record of what that reasoning would be? 00:25:34
Well, definitely you would have minutes from those meetings and from both Planning Commission and City Council. 00:25:41
Whether or not the. 00:25:48
That was a long time ago. It's possible that they would be happy to talk about that directly. Sure, we can. Yeah, you can take a 00:25:51
look at that for sure. 00:25:54
So long term rentals are not allowed in the PO zone. 00:25:59
They would be under the mixed-use planned unit development. They're allowed as a conditional use permit which has been approved at 00:26:03
this site. So a long term rental could so it's a live work type situation where someone could live upstairs and work in the space 00:26:10
below. That was sort of the idea that it could be allowed a short term rental was was something that wasn't necessarily included, 00:26:17
but a long term rental code. Yeah, I mean so totally different like. 00:26:24
Somebody has an apartment or a home above their office and or rents to somebody that has an office as opposed to. 00:26:32
We want to turn it into an Airbnb. 00:26:41
Yeah, essentially. 00:26:44

And so as I understand it that the code then requires that the. 00:26:47
There's a connection or a link between the. 00:26:52
Professional use and the person living in the long term rental not directly, but that would have been the idea is that it's sort 00:26:56
of to address even if an affordability notion. 00:27:02
That someone could live above the space that they work at. 00:27:09
And have that option available in throughout the city. 00:27:12
But requiring them to be the one that lives there and also runs the office was not something that was required. 00:27:18
And I think that's one of the reasons why it's proposed as condition. 00:27:24
All short term rental. 00:27:29
Approvals in the city or conditional approvals granted by the Planning Commission, which in this case is a land use authority. 00:27:31
So that they can assess impact, you know, based on the specific circumstances, right. Yeah. 00:27:38
And this one specifically, this is one that's just north of the Fairfield Inn, is that correct? 00:27:46
That white colonial looking. 00:27:52

So I want to give the Council a little bit of understanding of how we got to where. 00:28:21
So I'll do my best of giving you the explanation of what the zones are and and why it is the PO is what we want. So this 00:28:26
particular piece of property is a little bit different. It's in the Highland Dr. general use plan, the Highland Dr. plan. If you 00:28:31
remember when we did the rezoning, there were some public comment the neighborhood did not want this to be commercial, which is 00:28:37
what it was supposed to be C2. 00:28:42
C2 would allow conditionally the short term rentals the. 00:28:49
The purpose of this is that for my parents to be able to live in this building for the remainder of their lives, they've taken the 00:28:56
top floor of that or the planets take the top floor of that. We're working through the building Commission, building inspectors. 00:29:02
But to move that into their apartment, they separated into two apartments so that the plans have to be two apartment there's and a 00:29:09
secondary 1 because it's bigger than what they need in the room zone. 00:29:16
The. 00:29:23
Entire building could have been turned into residential or the entire building could have been turned into commercial or remained 00:29:25
as commercial as it was. The PO zone when that was created in 2018, gave the ability to create these offices. But to have the live 00:29:31
work situation, kind of the update of the code as society has gotten to that point, has gotten to the point where we like having 00:29:37
commercial uses on the main floor, residential uses above that. 00:29:43
As for the PO zone, what seems to be have designed to have been done? 00:29:50
Is it creates this where we can have the live work under a conditional use permit that's been obtained for this particular 00:29:54
property, for any property that would want to have the conditional use of residence and even potentially the conditional use of a? 00:30:01
Short term rentals. It would be a 2 step process, just as the applicant here has undergone. It's a 2 step process. 00:30:10
What they would like is to have the permit, the short term rentals permitted here. If the council will remember or recall both 00:30:16
the, I believe it's RM and R2 zoning permit short term rentals. The CN, excuse me, the C2 permit short term rentals. PEO seems to 00:30:22
be a bit of an outlier here. 00:30:28
And we think what we're asking the council to do is to correct this as an outlier to allow the conditional use of short term 00:30:36
rentals in this PO zone, Certainly something that can be looked at on a case by case basis, but something that must be. 00:30:43
The statute of let, the council must change the text of the PO zone in order to allow it. I would like to remind the council that 00:30:52
there the Planning Commission, there's a little bit of a procedural irregularity in that although there was a negative 00:30:58
recommendation forwarded from the Planning Commission, the applicant was not given notice of the hearing. We've gone, we've 00:31:04
listened to the minutes into the audio of the hearing. There's one of the members of the Planning Commission that's very much in 00:31:10
favor and says this is what needs to happen. 00:31:16
Another member of the Planning Commission that said. Why is the applicant not here? Another member of the Planning Commission that 00:31:22
said. 00:31:26
This person came and rezoned this to PO. They're now here. They came and asked for conditional use permit. Now they're asking for 00:31:31
a short term rental. What are they doing? I think we're we ought to just vote no. We have two people on the Planning Commission, I 00:31:38
believe it was 2 that were largely against allowing the short term rentals here and allowing the short term rentals anywhere. 00:31:44
In the PIO zone, and I think that reflects somewhat of the political reality that we live in is that there are a lot of people 00:31:51
that do not want short term rentals to be anywhere I. 00:31:56
If we look at the if the Council looks at the staff report, the Council should consider three factors determining whether to 00:32:01
approve or deny the proposed amendment. The first would be whether the proposed amendment is consistent consistent with the goals, 00:32:08
objectives and policies of the cities general plan. The second would be whether the proposed amendment is harmonious with the 00:32:15
overall character of the existing development in the vicinity of the in the vicinity of the subject property. And 3rd. 00:32:22
The extent to which the proposed amendment may adversely affect abutting properties. 00:32:29
Adequacy of facilities and services intended to serve the subject property such as roadways, parks, recreational facilities, etc. 00:32:33
If we look at factor number one, I think the Highland Dr. Master plan adequately addresses this. It has an in segment C of the 00:32:42
Highland Dr. Master plan. 00:32:45
And it's primarily zoned for commercial purposes. As I noted earlier, the reason this property was rezoned to PIO as opposed to 00:32:50
the C2, which is what the master plan called for, was because the community did not want C2 specifically because they had problems 00:32:56
with the property just to the north of that strip mall. And they they were very much against having this property rezoned to the 00:33:01
the C2, which is again why the applicant wanted PL. because for their purposes, they want to live here and rent the remainder of 00:33:07
it out. They do not have. 00:33:13
Another office there, although I think the intent is that they'll run some of their businesses out of a conference room on the 00:33:19
main floor, but it's not specifically, I guess, live work as we may generally look at that. 00:33:26
The. 00:33:34
The general plan discusses incorporating the mixed-use into the primarily commercial. 00:33:36
What we're supposed to do also with the PIO is create a buffer zone between the heavy commercial and the residential. 00:33:42
Allowing short term rentals here would do exactly that. It would actually lessen the impact of the commercial because, as noted in 00:33:50
the Council report, I. 00:33:53
So the commercial is used during the day, the short term rental is used, nobody's there during the day, it's used during the 00:33:59
night. So as opposed to having high volume use during the day and then no use at night, there'd be minimal use or less use during 00:34:03
the day and then minimal use at night. 00:34:07
I also would note that specifically next door to this property is the Fairfield Inn that was rezoned to Ord. 00:34:12
And so this property seems to be one particularly situated that would be appropriate for the council to look at, for the council 00:34:20
to be able to conditionally allow it if the council wanted to do that. We can't do that unless and until the PO zone gets amended. 00:34:26
The. 00:34:34
There seem to be adequate facilities, pedestrian center, bus hub, other public transit options. The street size is one of the 00:34:38
things that the the council report talks about. The street sites here as well as everywhere else in the PO zone as well as 00:34:43
everywhere in the room zone. All the buildings are appropriately St. sized for the potential use of the short term rentals is 00:34:49
called out in the code. 00:34:54
Also one thing that I want the council to recognize is that as noted in the report to these buildings that are in the PO zone 00:35:03
generally are as I noted before have been the room. So they're either complete residential or complete office and the city has 00:35:09
made a point of trying to turn those into office buildings. Allowing some of that residential to remain will increase the buffer 00:35:15
zone that's there will allow. 00:35:21
The city to better plan. 00:35:28
Specifically, these soft buffer zones between the dense commercial that is noted in the general plan of often on that Highland Dr. 00:35:32
corridor and the residential that comes off of that. 00:35:38
With the second and third part of that, the. 00:35:50
And I think I've addressed the harmonious character of the existing development and the vicinity of this particular property. And 00:35:54
also with all of the RM zone and all of the PO zone, we've reached out there. As noted in the Council report, there are presently 00:36:01
8 properties in the PO Zone. Of those, we've submitted letters on behalf of, I believe. 00:36:07
Five of those property owners. 00:36:14
The fifth one, Mr. Ensign, who owns. 00:36:18
2225 Holiday LLC asked us to tell the council that he supports short term rentals to be added to the PO zone as a conditional use. 00:36:23
We didn't go through and pull all of the individuals that owned the RM zoning. I believe there were 36 or 38 of those. 00:36:31
But we think they are likely to be in favor because it allows the additional uses in the what amount to less use of these 00:36:40
properties, less severe use than purely an office use would dictate or purely residential use would dictate. And it seems to 00:36:45
further the the city's goal of the general plan. And then third, the extent to which the amendment, the proposed amendment may 00:36:51
adversely affect any abutting properties, the adequacy facilities and services such as roadways, parks, recreational facilities, 00:36:57
police and Fire Protection and etcetera. 00:37:02
And I think all of that is effectively done by making sure that these types of properties that would be in the in the PO zone or 00:37:09
the RM zone, which would potentially be rezoned to PO are wide enough. There's simply no negative. 00:37:16
Potentiality of allowing the PO zone in this text amendment, and I'll note that although the council report gives a negative 00:37:25
recommendation, it doesn't say you shouldn't ever do it. It says, let's look at this again in 2025 when we redo the entire general 00:37:31
plan, which is part of what we heard when we came in with the rezoning application. Well, this is supposed to be C2, but maybe 00:37:37
this should really not be C2, maybe should really go to PL. 00:37:42
To simply kick the can down the road I think is not the appropriate thing to do here. What we're asking is that the council be 00:37:49
given the discretion to allow these properties to be short term rentals if there's an investor such as as the owners of this 00:37:56
property that want to turn this into the kind of the next generation of properties that have the mixed-use. 00:38:03

Municipalities no longer have to have made that resolution that we made back in 2019, and that opens up the possibility of new 00:44:45
municipalities joining the program. Now Mill Creek has done so. Excuse me, not Mill Creek. 00:44:55
Midvale knew there was an M in there somewhere. Midvale. Midvale is now going to be a participating community. 00:45:08
And because the original utility agreement listed the names of all of the participating municipalities, we had to change that. We 00:45:17
also updated names for currents and immigration Canyon from Township to city. There was another bill that changed the. 00:45:27
That supposedly updated renewable to clean and there I know people who don't agree with that, but that's not for tonight's debate. 00:45:39
Umm, so there are just some small tweaks. One of the things that thank goodness someone thought to put in this is that if there 00:45:50

have 3 items I wanted to present to council. The 1st news event I wanted to share is yesterday we had our official kickoff of the 00:48:22
general plan update under the leadership of John Tier Link. And you're going to get a full presentation on that project, including 00:48:28
the timeline that will proceed over the next year at your December meeting and. 00:48:35
Right now, the team's going to be working on getting a steering committee together. 00:48:42
Developing a community engagement plan and conducting an existing conditions and plans audit. So watch for more on that in 00:48:47
December. But Speaking of the general plan, there's a new grant program that's been established by the Department of Water 00:48:53
Resources. This is a grant that would help us satisfy the requirement that's now part of a general plan. 00:49:00
If you remember, we got a really generous grant from the WFRC to do our general plan update. But what this would do is give us 00:49:06
even additional funds. So Carrie Marsh is working on that application. It's due on October 24th. If there's no concerns about us 00:49:12
pursuing that, we will put in an application and hopefully get some more funds. 00:49:18
OK, registration for the National League of Cities, their 2025 Congressional city conference that's been held in Washington, DC, 00:49:25
is going to open in November. And we talked about this opportunity last spring as a way to build our relationship with the Utah 00:49:31
congressional delegation. And I just wanted to check in to see who on the council would possibly want to attend that. I can send 00:49:37

find a program name that we can market and that we can use to describe all the different history elements that we have in the city 00:50:28

So the steering committee, as well as our project consultant and city staff came up with some options. So what I'm going to do is 00:50:40
just read you a couple of names. These are not final names, but I just wanted to get your reaction to some of the words and see if 00:50:46
there are words that you really like or words that are a no go. And this will just help us as we kind of finalize things. So the 00:50:52
first option is called Holiday Echoes a Living History. 00:50:58
And just an example with that name, the walk that we're doing in the park, Outback would be called Holiday Echoes Heritage Walk. 00:51:04
So that's one option or words. Another option is rooted together, a living museum. 00:51:11
And as another example, our walk could be called They're Rooted together walk or Rooted Together Heritage Walk. And what we're 00:51:18
trying to do is we know this is history, but we're trying to use words again that we can kind of say quicker and that we can start 00:51:24
