I'm here to talk about the fencing ordinance along our major thoroughfares. 00:01:36
The one that just got built at the top of Cottonwood Lane, that big concrete wall that's six feet tall, seems like 8 feet. 00:01:42
When I was on the Planning Commission, we tried to talk about a way to make this more. 00:01:50
Pedestrian friendly. 00:01:55
And we talked about and I thought this is what the ordinance had, something along the lines of like. 00:01:57
36 inches at the property line. 00:02:02
And for every inch you move back, you got an inch up, two inches of her, maybe 2 inches back, one inch of height. There's 00:02:05
something like that because. 00:02:08
I'm afraid that specifically about Holiday Blvd. but are a major thoroughfares. We're just tunneling off our city. 00:02:13
And psychologically, we're pushing pedestrians into the street. It's not a comfortable place to be. 00:02:19
If any of you have walked along that, or if you run along Highland Dr. Sometimes I'll. 00:02:26
About my running route will take me along Highland Drive. 00:02:34
There's just some harsh fence, a little bit of concrete and that it. 00:02:37
It's safe enough, like technically, but it's not something that someone is going to want to walk their kids down that street. 00:02:42
And I think we just need to really kind of rethink. 00:02:48
This fencing ordinance along our major thoroughfares so. 00:02:51
I believe that everything has been built except that atrocity on Castle Lane is within our ordinance. 00:02:54
But I propose that we put together a task force, and as the general plan approaches, we get this. 00:03:01
Fixed so that we don't keep seeing. 00:03:06
These new developments. 00:03:08
Because property owners, they just want to. 00:03:10
They're not concerned about the public side of their fence, so they're just going to keep building these big fences. 00:03:13
So that's my thought and I would be happy to be involved in any sort of. 00:03:19

Before we bring Carrie up, you know, I would like to just make a comment that and I don't know if any of the other council members 00:04:18
have noticed, but. 00:04:22
The quality of the staff reports I think are excellent and a lot of times we're not the expert on these issues. 00:04:26
And so we rely heavily on our staff. 00:04:32
To give us the information we need to make sure we're making responsible decisions, so. 00:04:36
These staff reports, I think have been very good, very helpful, and so who's ever the author of them? In this particular case, 00:04:41
maybe you carry. 00:04:45

And what that will bite you up to, just kind of give us an overview on what we're going to be looking at. 00:04:52

Great. Thank you, Mayor. So this is a proposed ordinance amendment to our existing accessory dwelling unit ordinance. 00:05:04
Some background history on this is in 2021 the state mandated that cities allow accessory dwelling units, removed a lot of the 00:05:15
controls on internal accessory dwelling units, but left a lot of regulations in cities hands for external dwelling units 00:05:23
considering that they are substantially different than what would be contained within a primary structure. Considering that the 00:05:31
code was amended to only allow external dwelling units on. 00:05:38
Lots that are half an acre or larger. 00:05:47
That there was a series. 00:05:50
Public hearings with Planning Commission in 2021 and then it came to City Council in 2021, so that's what the existing. 00:05:54
Resulting code was from those public hearings. 00:06:03
In the planning office, we have residents that come. 00:06:08
And apply for permits. They're looking to add an accessory dwelling unit to their property, usually in the form of a garage with a 00:06:13
unit above it or some other configuration. You see, like a lot of pool houses that they want to use as a rentable accessory 00:06:20
dwelling unit. We've had to. 00:06:27
Not allow or not. 00:06:34
Issue an accessory dwelling unit permit for structures that are built. 00:06:37
That are not part of the main structure, so an external accessory dwelling unit on parcels that are less than half an acre, 00:06:43
because it's not. 00:06:47
In line with the code, they can build those structures. They can use them for personal use, family members, but they couldn't rent 00:06:52
them out if their parcel is less than half an acre. 00:06:57
In let's see, it was last year we had. 00:07:04
Direction from council to look at what our Adu ordinance is. 00:07:09
Specifically to look at. 00:07:15
Allowing converting existing accessory buildings. 00:07:17
Into um. 00:07:22
Permitted external Adu's. So that would be some of these buildings that were built that maybe have some occupiable space. 00:07:23
How could they be converted to be a rentable accessory dwelling unit? 00:07:34
So the changes in the. 00:07:40
Are kind of in line with that of. 00:07:43
What are some of the issues that are preventing the conversion of existing accessory dwelling units or accessory structures so 00:07:47
that they can be rentable? 00:07:52
So there is a summary of changes in the table. We went through several. 00:07:57
Meetings with the Planning Commission. 00:08:03
The public hearing was open for all three meetings that we had with the Planning Commission. 00:08:05
The staff report. 00:08:11
What the current language is for accessory development units, what the staff originally recommended to the Planning Commission and 00:08:13
then a summary of what the Planning Commission recommended in various changes as we went through the the three separate meetings. 00:08:22
I think the table in there summarizes things pretty well. 00:08:33
The Planning Commission was not comfortable with. 00:08:38
Umm going down the route of looking at converting existing structures. 00:08:43
They decided to. 00:08:50
Allow external dwelling units on lots smaller than half an acre, but added some additional restrictions on their limiting the 00:08:53
height. 00:08:57
Within a certain distance of the property and then increasing the setbacks. 00:09:02
I think that's all pretty summarized. I don't. And we can go through questions that you have on any of those changes and maybe 00:09:08
discuss some of the differences between staff recommendation and the Planning Commission's proposed text. 00:09:15

OK, Mayor, one other thought on this too, in preparation for the 11th I don't when it says Planning Commission recommended as a 00:10:43
collective. I mean, I'm assuming this is where where they landed the majority, right? But would it be difficult on those two? 00:10:50
Because I'm assuming especially in these cases where it differs from what staff recommendation was, I'd be curious to know. 00:10:56
Like what what the, you know, how the vote voting assuming that maybe they weren't each voted on two. I don't know. But it'd be 00:11:03
interesting to know how unanimous the vote was and what the Planning Commission is recommending or not sure. Yeah, we had the 00:11:09
language was sent to the commissioners and they each sent responses back on the language. So that would be something that I can 00:11:15
forward on to the council that some individual comments from each commissioner and that gives you an idea of where each of them 00:11:21
stands on on each of the items. 00:11:27
It might not be bad if it's not hard, but it might not be hard to have that as a as a as a resource that needs to refer to. OK, 00:11:37

I think the language that we had reviewed across the hall on page 56, paragraph I, sub paragraphs one and two and exhibit C, page 00:16:36
61 at least on the computer clarified who can. The big issue we were struggling with was who can actually run a home occupation 00:16:42
business and what kind of guidance can we give to staff to allow them to approve it without going to Planning Commission. I think. 00:16:48
I think that language kind of got there. 00:16:54
But having said that, I know Councilmember Brewer had some comments he wanted to make and then we'll see what other discussion the 00:17:01
council has before we take a motion. 00:17:05

was discussed. And my understanding is, is that previous to this ordinance being enacted we've had thus far it's these questions 00:17:16

I think I think what we have does a good job of striking a balance but when. But I'm also apprehensive just because when we put 00:17:57
things like this in place what does that entail for the public if they come up against something that we find to be onerous for 00:18:04

we come in a circumstance we find that it may not fit all circumstances or that what what's the process and what and what happens. 00:18:46

Numbered item number two in this is it states that for home occupations that are outside of these standards then they would apply 00:19:37
for a conditional use permit. 00:19:42
So in a conditional use permit where they have maybe larger groups than six, they would have to show you know where their parking 00:19:47
is, all those things and the Planning Commission would review that and mitigate any potential impacts or review their their 00:19:52

Got it. So so it still affords some flexibility then to accommodate different circumstances. Some people may live on large, you 00:20:02
know large pieces of property where it's not encumbering or creating a nuisance or those types of things. And so we allow for 00:20:10
accommodations for that. Otherwise if there are other issues then henceforth once this is codified that. 00:20:17
That we find that we don't like here. That requires then somebody on the City Council proposing an introduction of legislation and 00:20:25
then we have an ordinance change or something, right. It would have to then go through our code amendment process. Yeah. Got it. 00:20:32

Have been reaching out to the City of Holiday to look at ways we can they can integrate their program with the city we've thought 00:24:47
about integrating them with our. 00:24:52
Helping Hands of Holiday award that we generally do in September or we'll be doing in September. 00:25:00
The other initiative they they're helping us to look at is involving our schools. So one thing you might do if if you have an 00:25:06
opportunity to go to your community council meetings in April. 00:25:12

So that perhaps we can involve the schools in something. 00:25:22
Along these lines with this organization in September, the great thing about this organization is they're not a fundraising 00:25:26
organization. They are already fully funded. 00:25:31
Their only objective is to try to spread. 00:25:35

Try to engage in kindness more often. 00:25:41
And they provide, you know, T-shirts and hoodies and other like pizza parties and they fund it all. 00:25:44

Commercial businesses and municipalities such as ours to engage with them and they help us find ways to spread that message, 00:25:54
assuming we're in agreement with trying to spread a little kindness in our municipality, which I'm in favor of and I hope you will 00:26:01
be too. So we'll try to get you some information by the end of the month that you can have in your hands for if you have an 00:26:08
opportunity before community councils dissolve. 00:26:15
For the summer, I know frequently made doesn't even have a meeting, but April may be the last shot and so we might want to have an 00:26:22

Board to engage with Curtis Bennett and his staff, to try to find a way for the the schools to become involved. That's why they 00:26:40

Which has been rebranded as Utah Renewable. 00:27:06
Utah Renewable Communities, which is a little bit less of a mouthful. Which is good. 00:27:10
Um, you probably remember the Inflation Reduction Act, the large federal? 00:27:15
Bill, that was passed probably a couple of years ago now anyway. 00:27:21
The Utah renewable communities is. 00:27:27
Applying for a grant from the EPA. 00:27:30
For a climate, it's called a Climate Pollution Reduction Grant. 00:27:33
And it's great because if we can get the grant, we're asking for $2,000,000. 00:27:38
And that money would go toward reducing. 00:27:42
The cost to the initial you know, all our residents who sign up initially and. 00:27:47
Could, if the numbers that we're looking at hold up, could cut. 00:27:53

Fee for participating in this program. 00:28:00

The reason I'm bringing it up is I have to sign a letter. 00:28:06

Let me just read really quick, CPRG implementation. Grant would primarily be used to cover the estimated excess cost of roughly 00:28:25
half of the program's new clean energy target. 00:28:31
On the first five years of program administration costs, one of the things that we're struggling with is the fact that. 00:28:38
Rocky Mountain Power cannot. 00:28:45
Shift any of the cost of the program to. 00:28:48
Participants and so we're having, I mean it's sort of. 00:28:52
Tangled mess that we're trying to untangle. 00:28:56
So if we could get this money and just hand it to Rocky Mountain and say. 00:29:00
This is going to pay for the extra telephone operators for people who are calling about with questions about the program. 00:29:05
And you know, upgrades to your billing system that you were going to have to make in order to be able to build just the 00:29:14
participants, things like this. So we're excited about this and hopefully. 00:29:19
Keep our fingers crossed, we'll hopefully get the money. 00:29:25
The second item I have goes right along with Paul. I'm really happy to hear about the kindness initiatives. 00:29:29
A few weeks ago, I was in a community council meeting listening to a. 00:29:37
A mother talk about the struggles of her children. She has a child. Both Elementary. 00:29:42
Middle school and high school. 00:29:50
This this woman is a black woman and her children have all on all three levels been. 00:29:52
The target of racial slurs? Slurs. 00:29:59
And so. 00:30:02
That will be really good news. And I just felt so bad listening to her talk. I'm. 00:30:04
I'm pleased with the. 00:30:11
Support that we've given. What was it, a couple years ago? We had the March. 00:30:14

When I was on the Planning Commission, we tried to talk about a way to make this more. 00:01:50
Pedestrian friendly. 00:01:55
And we talked about and I thought this is what the ordinance had, something along the lines of like. 00:01:57
36 inches at the property line. 00:02:02
And for every inch you move back, you got an inch up, two inches of her, maybe 2 inches back, one inch of height. There's 00:02:05
something like that because. 00:02:08
I'm afraid that specifically about Holiday Blvd. but are a major thoroughfares. We're just tunneling off our city. 00:02:13
And psychologically, we're pushing pedestrians into the street. It's not a comfortable place to be. 00:02:19
If any of you have walked along that, or if you run along Highland Dr. Sometimes I'll. 00:02:26
About my running route will take me along Highland Drive. 00:02:34
There's just some harsh fence, a little bit of concrete and that it. 00:02:37
It's safe enough, like technically, but it's not something that someone is going to want to walk their kids down that street. 00:02:42
And I think we just need to really kind of rethink. 00:02:48
This fencing ordinance along our major thoroughfares so. 00:02:51
I believe that everything has been built except that atrocity on Castle Lane is within our ordinance. 00:02:54

The quality of the staff reports I think are excellent and a lot of times we're not the expert on these issues. 00:04:26
And so we rely heavily on our staff. 00:04:32
To give us the information we need to make sure we're making responsible decisions, so. 00:04:36
These staff reports, I think have been very good, very helpful, and so who's ever the author of them? In this particular case, 00:04:41

Great. Thank you, Mayor. So this is a proposed ordinance amendment to our existing accessory dwelling unit ordinance. 00:05:04
Some background history on this is in 2021 the state mandated that cities allow accessory dwelling units, removed a lot of the 00:05:15
controls on internal accessory dwelling units, but left a lot of regulations in cities hands for external dwelling units 00:05:23
considering that they are substantially different than what would be contained within a primary structure. Considering that the 00:05:31
code was amended to only allow external dwelling units on. 00:05:38
Lots that are half an acre or larger. 00:05:47
That there was a series. 00:05:50
Public hearings with Planning Commission in 2021 and then it came to City Council in 2021, so that's what the existing. 00:05:54
Resulting code was from those public hearings. 00:06:03
In the planning office, we have residents that come. 00:06:08
And apply for permits. They're looking to add an accessory dwelling unit to their property, usually in the form of a garage with a 00:06:13
unit above it or some other configuration. You see, like a lot of pool houses that they want to use as a rentable accessory 00:06:20
dwelling unit. We've had to. 00:06:27
Not allow or not. 00:06:34
Issue an accessory dwelling unit permit for structures that are built. 00:06:37
That are not part of the main structure, so an external accessory dwelling unit on parcels that are less than half an acre, 00:06:43
because it's not. 00:06:47
In line with the code, they can build those structures. They can use them for personal use, family members, but they couldn't rent 00:06:52
them out if their parcel is less than half an acre. 00:06:57
In let's see, it was last year we had. 00:07:04
Direction from council to look at what our Adu ordinance is. 00:07:09
Specifically to look at. 00:07:15
Allowing converting existing accessory buildings. 00:07:17
Into um. 00:07:22
Permitted external Adu's. So that would be some of these buildings that were built that maybe have some occupiable space. 00:07:23
How could they be converted to be a rentable accessory dwelling unit? 00:07:34
So the changes in the. 00:07:40
Are kind of in line with that of. 00:07:43
What are some of the issues that are preventing the conversion of existing accessory dwelling units or accessory structures so 00:07:47
that they can be rentable? 00:07:52
So there is a summary of changes in the table. We went through several. 00:07:57
Meetings with the Planning Commission. 00:08:03
The public hearing was open for all three meetings that we had with the Planning Commission. 00:08:05
The staff report. 00:08:11
What the current language is for accessory development units, what the staff originally recommended to the Planning Commission and 00:08:13
then a summary of what the Planning Commission recommended in various changes as we went through the the three separate meetings. 00:08:22

The Planning Commission was not comfortable with. 00:08:38
Umm going down the route of looking at converting existing structures. 00:08:43
They decided to. 00:08:50
Allow external dwelling units on lots smaller than half an acre, but added some additional restrictions on their limiting the 00:08:53
height. 00:08:57
Within a certain distance of the property and then increasing the setbacks. 00:09:02
I think that's all pretty summarized. I don't. And we can go through questions that you have on any of those changes and maybe 00:09:08
discuss some of the differences between staff recommendation and the Planning Commission's proposed text. 00:09:15

Because I'm assuming especially in these cases where it differs from what staff recommendation was, I'd be curious to know. 00:10:56
Like what what the, you know, how the vote voting assuming that maybe they weren't each voted on two. I don't know. But it'd be 00:11:03
interesting to know how unanimous the vote was and what the Planning Commission is recommending or not sure. Yeah, we had the 00:11:09
language was sent to the commissioners and they each sent responses back on the language. So that would be something that I can 00:11:15
forward on to the council that some individual comments from each commissioner and that gives you an idea of where each of them 00:11:21

business and what kind of guidance can we give to staff to allow them to approve it without going to Planning Commission. I think. 00:16:48

But having said that, I know Councilmember Brewer had some comments he wanted to make and then we'll see what other discussion the 00:17:01
council has before we take a motion. 00:17:05

is, all those things and the Planning Commission would review that and mitigate any potential impacts or review their their 00:19:52

Got it. So so it still affords some flexibility then to accommodate different circumstances. Some people may live on large, you 00:20:02
know large pieces of property where it's not encumbering or creating a nuisance or those types of things. And so we allow for 00:20:10

That we find that we don't like here. That requires then somebody on the City Council proposing an introduction of legislation and 00:20:25
