rezone at 6571 S Big Cottonwood Canyon Rd. 00:02:34
From residential to multifamily residential, multifamily to office, research, development, or Ord. 00:02:41
Before we open up that public hearing, we will hear from John Tierlink. 00:02:49
Who will kind of give us an overview on the staff report which is in the packet and then I believe the applicants are here. 00:02:55
So, John, let's start with you and then we'll take it from there. 00:03:01
Thank you, Mayor. The Community Economic Development Department received an application for a rezone. 00:03:05
Located at. 00:03:11
Right on Big Cottonwood Canyon Rd. just on the southern border of the city. 00:03:14
The request is to rezone the property from this current zone RM to the abutting zone Ord, which is RM Residential Multifamily to 00:03:19
Ord Office Research, Research and Development. 00:03:26
The application was reviewed by the Technical Review Committee for completeness and then forwarded on to the Planning Commission, 00:03:34
who held their hearing. 00:03:37
Earlier last month. 00:03:42
The Planning Commission at that meeting did make a recommendation to City Council to approve the rezone. 00:03:44
The merits of the application were brought forth by the applicant who was here tonight and he can talk about the reasoning behind 00:03:52
isn't that his request primarily from the staff's point of view and the planning commission's recommendation for approval was 00:03:59
compliance with elements of the Ord zone which provides for one residential multi family housing? 00:04:07
Something that was text amended into that zone earlier this year. 00:04:16
Specifically, that means that primarily the Ord zone was. 00:04:21
Very vast array of uses that are allowed in that area as being the more intense office in a commercial zone. 00:04:25
But to also allow for residential units. 00:04:33
To be built there and primarily for the purpose of addressing some housing need and different housing types of units that the city 00:04:37
could possibly foresee in that location. 00:04:43
At this location, the general plan foresees professional office. 00:04:51
And commercial, obviously this is not that. This application for the property owner is not either office or commercial. 00:04:56
And we can allow him to elaborate on that a little bit further, but primarily for residential uses. 00:05:04
Your Ord zone is an intense zone which comes with it intense massing building sizes. 00:05:11
However, when we crafted the Ord zone, when we incorporated built into that set back and buffering requirements next to 00:05:19
residential properties. 00:05:24
Knowing that our southern boundary with our neighboring city, Cottonwood Heights, has numerous single family homes, that buffer is 00:05:30
extremely important when we talk about height. 00:05:35
Currently, the OR or the RM zone requires a set back of 25 feet. 00:05:42
The Ord zone requires a 30 foot set back from residential properties, so a little bit further. 00:05:50
But for a 30 foot maximum height. 00:05:58
The reasoning being is if you the bigger the building is and more massing it has, the further away from the property line it 00:06:01
needed to be so. 00:06:04
Once you go over 30 feet you have a one to one transition. 00:06:08
To go up to whatever the Max height for that lot could possibly be. John, what's the Max height in room? 00:06:12
75 Oh, sorry, 40 feet. 40 feet, yes. 00:06:19
In fact, in this on this lot, it would be 35 per room as well. RM's heights are tied to the lot size. 00:06:24
So you don't get 40 feet until you're above an acre. This lot size is .88. 00:06:33
So they're they're hovering in that 435 foot zone. 00:06:38
Excuse me, this is a question better left for the work session, but given that one to one set back height ratio and given the size 00:06:45
of the lot, what's the realistic height that a building could be in this lot? 00:06:52
I haven't gotten that answer for you right now, but I can definitely take a look at it. 00:07:01
I the site is constrained by slope. 00:07:07
Significantly, I. 00:07:11
About seven years ago we did have a site plan approved here for a multi family building. 00:07:14
That was approved by the Planning Commission that would never always follow through upon. 00:07:19
But from what I recall, the footprint was. 00:07:25
Significantly smaller than what you would believe it to be. I mean looking at an aerial image it looks like a big large lot, but 00:07:28
really I would say only 1/4 of it is. 00:07:33
Buildable, so constrained by slope on the on the east side and on the north side, and then set back on the South side. 00:07:39
It's hard to say exactly what the massing would look like, but it's not. 00:07:49
Tremendously large. 00:07:52
Structure that could be built there? I guess I'm just wondering because even though this Ord zone would technically allow for 75 00:07:54
feet, it seems realistic. 00:07:57
Given the size of the law, we wouldn't, wouldn't be able to build that. Is that accurate for, yeah. For all intents and purposes, 00:08:01
you need to be 75 feet or at least away from that property line. And now you're getting into slopes that could. They're 00:08:06
unbuildable. They're steeper than 30%. 00:08:11
Yeah, so if they go like the. 00:08:17
Side set back would be next to the residential area. That's the issue here. 00:08:22
So they'll have to have a 30 foot set back at a 30 foot height and then if they want to go higher than that. 00:08:27
They're going to have to continue moving a foot away from. 00:08:34
The 30 foot set back, correct? So if they go to 75 feet, they're going to have to have 75 feet of set back, right? 00:08:38
I do want to make mention the number the density that's allowed in the Ord zone. 00:08:52
Room is currently allows for 16 units an acre. 00:08:55
So right now a lot would be have a right to build somewhere between 12 to 13 ish units at the .88 acre size. 00:08:59
The Ord zone does not have a density allowance, does not have a ceiling. 00:09:09
The reason for that being is that. 00:09:14
One you have a part, we have a restraint for parking if you can park it, and you can build it under the maximum height keeping 2 00:09:16
slopes. 00:09:19
And the elements that. 00:09:24
Sort of circumvent density allowances, which is mainly centers around parking. 00:09:27
You can build as many units you could randomly fit into within that envelope. 00:09:33
I don't know what that number would be right now, but it would be limited to how much massing that that building could. 00:09:38
Could be built given the restraints. 00:09:44
Even though the application is looking for a residential use here. 00:09:48
UMM staff's opinion that it would be left could be left open also for the possibility of commercial uses, maybe as a mixed-use 00:09:55
situation on the main level. 00:09:59
Similar to what's across the street. 00:10:04
But that's something that can be talked about with the applicant. 00:10:07

We we've been building for probably over 35 years. 00:10:47
And I don't think we've seen a more challenging time for. 00:10:52
A potential homebuyers to find something in a good location that's. 00:10:59
Semi affordable and we think that. 00:11:06
Our potential development will help provide that need. 00:11:12
Right now is what's been discussed. There's a lot of constraints on this particular site. 00:11:16
And we're holiday residents and we certainly. 00:11:23
Take great pride in the projects and the different housing projects that we've done to make sure their quality of nature and they 00:11:29
look nice. And I think with the current zone, it would definitely cause us a lot of restrictions which would limit the quality of 00:11:36
the project that we're trying to do. 00:11:44
When you consider the huge hill in the back. 00:11:52
And then you've got the Christian School right on top of that across the way, you've got all that commercial area, as well as 00:11:56
across the street, you've got the the Salt Lake County Reservoir. 00:12:03
You do have the residential site to the kind of to the southeast, but I think in this zone they've covered that and protected 00:12:11
them. When you consider on an RM, you can go as close as 25 feet. 00:12:19
And here you're restricted to 30 feet and if you go higher, you have to do that one to one ratio, which has been described 00:12:29
earlier. 00:12:33
So I think and plus if you've been on site, you'll see the residential project is actually elevated. It's higher than our proposed 00:12:39
site. 00:12:44
So we think what we're proposing would be. 00:12:50
Would actually benefit this particular site and would actually be better for and tie in more with those communities that surround 00:12:54

In the pre meeting based off of some language that was in the staff report. I just want to make sure it's clear. 00:13:18
Because we've got into these discussions before on council where somebody goes through a rezone based off of the verbal. 00:13:26
Explanation of what they plan on putting there. 00:13:33
And unless we do it through a development agreement, you're entitled to what you're entitled to. So this application though, and I 00:13:36
want to put words in your mouth, but you would be open to working with the city on some kind of workforce housing, moderate income 00:13:44
housing and whatnot, but it would be an after the fact rezoned discussion. 00:13:52
If we rezone this to Ord, the owner will be entitled to. 00:14:01

They will be entitled to the entitlements under Ord. So that's what we're considering. I just want to make sure we're all clear on 00:14:07
that. And I think we are, yeah. In fact, we've, we've had discussions with Ann just trying to look at some of those alternatives 00:14:14
that perhaps might actually be more beneficial to the area and to the city and to future residents. So we're certainly open. We're 00:14:20
looking at all those different things. 00:14:27
And hopefully as we get through some of this process, we're working on all different kinds of plans, just trying to figure out 00:14:35
what would work best, but we would be very open to that. 00:14:40

Just one question as far as entrance and you know egress and that is that all on Big Common Canyon Rd. or could it be off of the 00:14:52
Old Mill Circle as well? No, it would all be on Old Mill Rd. 00:14:58
We were so constrained on all the different sides and right now would all be on Old Mill Rd. we'd probably or big Common Canyon. 00:15:05

Couple of items to talk about with the council tonight. First I. 00:16:14
You know, and always interesting subject park restrooms having received some feedback earlier this season in the spring about the 00:16:19
need to hopefully extend that time period we have negotiated with our cleaner to. 00:16:29
Clean those restrooms and therefore we can have the restrooms open from March 15th to October 15th. So we're adding an additional 00:16:40
month, two weeks on each side. 00:16:45
That will be at a cost of about $700.00, which we think we can absorb in the existing budget, moving much beyond that. 00:16:53
I think would be challenging just because of the need to find cleaners. 00:17:04
So I just wanted to know if the Council is good with those dates or if you want me to look at trying to extend it beyond those 00:17:10
dates. 00:17:15
Not that I'm trying to make eye contact with, but. 00:17:20
I'm outside of law. I see the need, especially at Knudsen Park. There's cyclists there all the time. And I think it always depends 00:17:25
on the weather every year. But I mean, from March to the end of September really is time that I think that trial gets used pretty 00:17:32
regularly. So I mean, ideally I think that if that's what I would prefer, but if we could extend it through from all of March to 00:17:39
the end of October, but I don't, but it's that's. 00:17:47
That's I would support that. I mean that's one that's input that I get. 00:17:55
Especially on Knutson park. I'm not sure I haven't heard much about this part but Knutson. 00:18:01
Where they ask if we can put porta potties in. 00:18:06
Because the people going through the park and not having, you know, so I mean, when you consider the alternative. 00:18:10
Yeah. Well, what's happening is that is that Cotton Bottom is getting overrun with people. And I feel like if we are creating a 00:18:17
space that's inviting people, which I think the park and the trails do, but I think we're responsible for meeting their needs is 00:18:24
kind of where I'm coming from on it and not pawing that off to. So maybe just it's not an all or nothing. Could we just consider 00:18:31
it maybe a Knutson? Yeah, a couple of weeks on either end. So the way our contract is negotiated, it has to be both. 00:18:39
That that's the way they have priced it for us. So until we renegotiate, which probably won't happen until we redo this building, 00:18:47
it would be for both. I agree we don't get many complaints about this facility, but I think in part because there's access to this 00:18:54
building for a lot of the time. 00:19:01
But I can certainly we can have the conversation about a March, the end of October, we'll assess their their willingness to 00:19:10
continue at that time period and then assuming they are, I can we can amend to that. Thank you, very good. 00:19:17

Secondly, we have installed the historic science that the council approved during a budget amendment in the last fiscal year. So 00:19:39
there's one on 6200 S just a little West of the Cotton bottom by the old Mill historic signage, one on an island, which we have to 00:19:47

Since Wendy's is no longer there, it's a little awkward, but that's where it is. 00:20:04
And then adjacent to Holiday Oil on Highland Drive and Murray Holiday Rd. 00:20:08
So take a look at those. I think they look fantastic. 00:20:16

3rd, I just wanted to let the council know and celebrate, although I'm a little afraid to say it out loud, that as of today, with 00:20:30
the hiring of our part time finance coordinator, we are now fully staffed for our permanent positions. And it's been a very long 00:20:39
time since that's been true. We're down a couple of seasonals, but for our permanent staff. 00:20:48
It may have been forever. 00:20:59
I'm not sure we've ever been that's ever been the case. 00:21:01
And then finally, Mayor, I don't know if you were going to mention the visit from Senator Lee staff, otherwise I would. Yeah, go 00:21:05
ahead. OK. So the mayor and I and Holly last week met with staff from Senator Lee's office, both his state office director and 00:21:12
then the region director. They were particularly interested in affordable housing questions, I think, both throughout the state 00:21:20
and in our city. 00:21:27
And whether there were any, any opportunities that they could provide help at their level. We also so we had a conversation about 00:21:35
housing and then we shared our ongoing need for. 00:21:41
Help from the federal government for some of our larger programs including Highland Drive, 39 S Trail and the seismic 00:21:49
reinforcement for this building. 00:21:54

Thankfully it's a good news, bad news situation. Thankfully, Miss Wojcick's insurance has agreed to. 00:22:34
Cover the cost of the cleanup. They have already paid that out to Utah Disaster Cleanup. 00:22:41
And you tried disaster cleanup, I believe is was ready to move on that, but now the Department of Air Quality has stepped in and 00:22:49
is requiring that. 00:22:54
All of the dirt be removed to a specific location and there's permitting and a process that they need to go to and be involved in 00:22:59
which increase increases the cost. 00:23:03
Again. So right now the city is. 00:23:08
No longer officially involved in any capacity, it's between Utah Disaster Cleanup and the Department of Air Quality. However, Miss 00:23:12
Bojack and her daughter, who are kind of trying to help manage this, are both highly motivated to get this taken care of. Is that 00:23:16
like, that's a good summary of things. 00:23:21
So I feel like it's we take two steps forward and one step back every time we address this. But I really appreciate everyone's 00:23:27
help on this because it has been a dynamic and changing situation. The second point that I want to make is Drew and I went to the 00:23:34
conference for the Utah League of Cities and Towns. And one of the many things that I got out of it that I just wanted to mention 00:23:41
is in two years is the 250 year anniversary of the signing of the Declaration of Independence and there are inviting. 00:23:48
All cities, municipalities, counties throughout the country to. 00:23:56
Include that as part of their 4th of July celebrations. Uh. 00:24:00
I feel like that's pretty easy. Low hanging fruit is something that we can add to that. So obviously that's a ways out, but I 00:24:06
think that that would be nice to add as part of the events that we already have in place. 00:24:11

Traffic problems at Morningside Elementary and I just want to say thank you to Jared for his ongoing help with that and also Chief 00:24:31
Oil and all his officers who go up there on a regular basis. We are still focusing on one specific area, one specific. 00:24:40

Some of you may have noticed we had another extremely successful Blue Moon Festival just within the last couple of weeks. And so I 00:25:12

And we had a great crew of volunteers. And even though the mid afternoon was extremely windy and our vendors had a bit of a 00:25:26
challenge getting their tents up by the time the event started and it all settled down. 00:25:33
But he was happy and seemed like it. I mean, I was. 00:25:40
Stuck behind the. 00:25:44
Beer ticket sales tent all day. So I didn't actually see a whole lot of it myself, but the part that I observed from my vantage 00:25:46
point was that everybody was having an extremely great time. And so another great year for the Blue Moon Festival. Like to 00:25:52
congratulate Terrence Council and particularly Megan adamant. Other Arts Council events coming up a week from Saturday that is 00:25:58

The 14th wave is the 13th. That's the dance thing. Yeah, the third. That would be a Friday then. So out here on City Hall Park, SB 00:26:10
Dance, they've been here before. They're quite entertaining and fun and they pop up a stage on the West End of City Hall Park and 00:26:18
put on a dance concert. And then our one summer concert series concert that was postponed due to poor weather. The. 00:26:27
Severn Bridges Rd. Eagles tribute band that's coming up on the last Saturday of the month. 00:26:37
And that should be great. And that would be a nice cooler evening with sun going down a little earlier. I think that, Gina, do you 00:26:43

But we'll see ads coming out in the regular channels, but I think that one starts earlier at 7, whereas the rest of the summer 00:26:56

And then you've got the Christian School right on top of that across the way, you've got all that commercial area, as well as 00:11:56
