OK, this is Commissioner Prince. I would like to welcome you to the. 00:00:04
Business or sorry, the planning meeting? No. What is this? The work session? 00:00:09
Of the Plant Holiday Planning Commission. 00:00:13
We have one item before us tonight, site plan modification of a PUD. 00:00:15
Highland Park. 00:00:22
Carrie, give us the rundown. 00:00:23
Oh sorry, let me fix. 00:00:27
Projection on the screen really quick. 00:00:30
Come back. 00:00:33
OK, so this is a PUD that was approved in 2022 originally. 00:00:35
And. 00:00:42
There was discussion on. 00:00:44
This one specifically with the backside. 00:00:46
I don't know why this. 00:00:50
Displays. 00:00:51
Switch it up. 00:00:53
Umm, I'll fix this before we go into our meeting. 00:00:58
So the. 00:01:03
The original site plan. 00:01:06
Showed the. 00:01:09
Townhomes. 00:01:11
In one section and then. 00:01:12
The. 00:01:15
Road that went back. 00:01:20
There was a couple of iterations where they switched the position of the road. 00:01:21
And with most of the open space for the PUD being in the. 00:01:26
Back end. 00:01:32
Toward the West side of the property. 00:01:34
So that's what was originally approved with tree removals. 00:01:36
Being tied to. 00:01:41
What was going to be impacted by building footprints and. 00:01:43
Roadways. 00:01:46
So let me pull up their site plan. So this was the original. 00:01:48
Approval. Tree canopy sustainability. 00:01:52
Those are the trees that are within the. 00:01:56
Billable areas. 00:01:59
And that were approved for removal. 00:02:00
Did I put in the? 00:02:03
Landscape Plan. 00:02:05
There should be in here. 00:02:07
And that group of photos that was included in the packet? 00:02:10
For today are the. 00:02:14
The new trees they want to take out. 00:02:16
Yes. So it's. 00:02:21
Specifically, would be the trees that are on the perimeter of the property. 00:02:22
So 6789. 00:02:28
14 is clearly within the where the road is. 00:02:30
These ones are within the building footprints. 00:02:34
This one is. 00:02:37
So. 00:02:38
That it likely is within the building footprint. 00:02:39
These two are. 00:02:43
The ones that are on the West side perimeter. 00:02:48
And where a lot of the open spaces. So here's. 00:02:50
Site plan without the tree overlay. 00:02:53
And it doesn't look like that. 00:02:58
Landscape. 00:03:01
In there, let me. 00:03:02
Pull that up. 00:03:04
It wasn't clear to me from the packet and I didn't stand by today. Have any of the Trees Act already been removed? 00:03:06
I don't there's, I don't think so. There's some pine trees up in the front that are. 00:03:16
Are dead. They were in the. 00:03:21
A site assessment by the. 00:03:26
The tree removal company. 00:03:28
Or who did the arborist assessment? 00:03:30
OK. 00:03:38
I think there was an issue with this size on the landscape plan. 00:03:47
I didn't get in there. 00:03:50
So remind me the ordinance. 00:04:07
That lets them do this. 00:04:10
Gives considerable deference to the. 00:04:12
Arborist. 00:04:16
For identifying which trees need to go and why. 00:04:19
That arbors is not our arborist. It's. 00:04:25
There are great. 00:04:28
Be that as it may. 00:04:31
The other tree situations we have like this, I mean it really hinged on. 00:04:33
If there's evidence from the. 00:04:38
Arborist that's. 00:04:42
We tend to be kind of deferential to that. 00:04:43
This arborist also is a tree removal company, is that correct? 00:04:49
Yeah. And that would be typical. 00:04:54
When you're starting. 00:04:56
You know a tree removal that you'd have? 00:04:58
A person who's associated with that tree removal company, who is an arborist, who's. 00:05:01
Checking out the trees, assessing their health, seeing what trees would be. 00:05:06
That should be kept or. 00:05:14
Not be kept. 00:05:16
And if I understood what we heard? 00:05:17
Isn't Sequoia now the tree company rather than dining tree which is? 00:05:20
Where they relied on. 00:05:25
Now Sequoia is the Sequoia is the developer. 00:05:27
OK. Yeah, that. 00:05:30
It sounded like, I guess we'll see who shows up, but it sounded like it. 00:05:33
This Sequoia has her own. 00:05:37
Arbor is now. 00:05:39
No, it's a different. I didn't get that impression. It's a different company. 00:05:41
So they have a separate company that's doing the tree removal that provided the. 00:05:45
Assessment. 00:05:49
The letter that's in the packet was the original. 00:05:51
Letter that we saw that was. 00:05:53
What the previous approval is based on just trees that are within those? 00:05:55
Building footprints and Rd. footprints were approved for. 00:06:01
Removal, so that's why it came back for an amendment, is because there are trees that are outside of those footprints. 00:06:05
That, uh. 00:06:11
The Planning Commission would have to approve for. 00:06:12
Additional renewal. Is this handled as a variance? 00:06:15
No, it's part of the conditional use permit with the PUD. 00:06:18
What are we looking at here in the landscape plan? OK, so this. 00:06:23
Is. 00:06:28
This is what they submitted for their. 00:06:30
For their landscaping plan. 00:06:32
And. 00:06:33
It didn't get added into the packet, so we will. 00:06:36
Look at. 00:06:42
In there and Brad, what do we need to do on the? 00:06:43
Procedural if this wasn't in like the. 00:06:47
In the packet. 00:06:50
But this is their landscaping plan. 00:06:52
The landscaping plan. When I looked at this one, it didn't look like it had ever like that. You'd ever seen the landscape plan for 00:06:57
what? 00:07:01
Proposed. 00:07:06
Replacement trees. 00:07:08
Would be. 00:07:10
So they list here what the. 00:07:12
Affected tree canopy is. 00:07:16
And. 00:07:18
Replacement would be. 00:07:20
OK. 00:07:28
OK. 00:07:30
Yes. 00:07:35
Yeah, and we did get one e-mail comment that John sent over. 00:07:36
So if they. 00:07:40
Show up then we can go through some of those questions, but. 00:07:43
Yeah, I think that this. 00:07:48
This was a weird file that just didn't go into the packet and I didn't notice that well when I sent it. 00:07:49
So this is their proposed replacement. So they have a lot of vegetation that they're putting here. 00:07:58
As some smaller trees. 00:08:04
This one. 00:08:06
Will be a bigger tree that they'll. 00:08:07
Put at the end of their fire, Turn around. 00:08:10
A bigger tree here and a bigger tree here. 00:08:12
This area is a stormwater retention area. 00:08:15
I don't think there's any trees in that area right now. 00:08:20
And then they have a big Willow tree here that they are proposed to keep. 00:08:24
They're proposing to keep that one. 00:08:30
Yeah, that might be a surprise to the developer. 00:08:32
Well, it's a surprise to that one guy, but he didn't get it's this one. 00:08:35
Yeah. 00:08:39
So this one has the Do not disturb on it. 00:08:40
Well that's confusing because it's a red X, but that is their. 00:08:44
That one would. 00:08:49
Would stay. 00:08:50
OK. 00:08:52
Oh, is that the? 00:08:54
Root cavity at the base with major deadlims. 00:08:58
I think so. 00:09:02
That's about what it looks like. 00:09:03
Cavity. Sorry. 00:09:05
And that one may be that it's because it's. 00:09:08
Toward the front of the site if there were significant issues with it later on. 00:09:10
Than they could remove it. 00:09:15
Without it, yeah. 00:09:16
OK. 00:09:18
Carrie, what do you have in the way of? 00:09:25
Guidance for us for has something like this come before Planning Commission in the past? 00:09:27
And what sorts of things have been? 00:09:34
Done. 00:09:36
Yeah, I think that there's. 00:09:37
Kind of a continual. 00:09:40
Question of tree quality or tree health. One of the intents of the tree canopy sustainability. 00:09:43
Ordinance is to. 00:09:51
Improve the tree canopy overtime. 00:09:54
Replacing some older trees or diseased trees with. 00:09:57
Newer degrees that then will. 00:10:01
Kind of replenish. 00:10:04
What the existing tree canopy is. 00:10:06
So there's. 00:10:09
That's I think that that can be accomplished. 00:10:10
There's a continual kind of difficulty with site development. 00:10:15
When you have trees that are maybe in questionable health. 00:10:19
That then. 00:10:24
Is easier to. 00:10:25
Remove them later when you have, you know, 12 townhomes that are in there and. 00:10:27
Versus now, so that's. 00:10:33
From the developer side, that's likely. 00:10:34
Easier to manage those trees. 00:10:37
Now and then put in fresh landscaping. 00:10:39
Fencing. I know that. 00:10:44
A lot of those are right. 00:10:45
Right on the border of. 00:10:46
Have some properties so. 00:10:49
They were. 00:10:52
They were unsure as to if they were on their property and then when they did like all their surveying and things in their 00:10:56
preliminary, that's when they're like, OK, these trees are within our. 00:11:00
Our boundary and. 00:11:05
Thus they be responsible for them. 00:11:07
So OK. 00:11:09
And the issues raised in the e-mail today. 00:11:11
By the adjoining. 00:11:16
The adjacent. 00:11:18
Complex. 00:11:18
The privacy and water drainage and. 00:11:21
Blah blah. Whatever. 00:11:25
Yeah, those. That strikes me as beyond our scope, right? Drainage is all managed with. 00:11:28
Engineering. That's just. 00:11:33
Typical ordinance anyway. Any drainage. 00:11:35
From your property can't be. 00:11:38
Drained onto neighboring properties. 00:11:40
So that will be. 00:11:43
You know, that's part of their engineering plans that. 00:11:44
The drainage will be retained on site. 00:11:47
Their main storm water retention, where they'll have. 00:11:49
Their on site retention going to will be a. 00:11:54
Area right here in the front. 00:11:58
OK. 00:12:02
So that will retain most of their. 00:12:04
And they'll do their site grading so that everything goes to that, to that central area. 00:12:06
Other questions with. 00:12:14
Privacy. 00:12:17
Typically any new development they're they're wanting to put. 00:12:19
New trees into. 00:12:23
For privacy for the. 00:12:25
New residents Privacy against existing residents. 00:12:27
Of course, it's going to be different once you have small trees versus your larger trees that are there. 00:12:30
And I discussed it in the staff report a little bit, just the difference in land use and how that changes overtime because the. 00:12:38
Existing glad use of just a small house that was on that site before there was so much open space and a lot of really big trees. 00:12:45
So when you are redeveloping that and you have your fire access and your building footprints. 00:12:51
It does have it will have a significant impact, but. 00:12:58
Within the land rates of that. 00:13:02
Property. 00:13:04
Yeah. And I think that on the note of quality of trees that they were discussing before, it's that we don't have anything in our 00:13:12
ordinance that is. 00:13:16
That takes into account what quality trees are. It's just a blanket coverage of. 00:13:20
All trees. 00:13:26
And so then as the Commission, that's. 00:13:28
Within your purview of. 00:13:30
You know, are these. 00:13:33
Does applicant have a? 00:13:36
A case that that you feel adequately. 00:13:39
Serves the tree canopy ordinance and the intents of a. 00:13:45
PUD with open space. 00:13:49
And the ordinance requires. 00:13:52
Placement. 00:13:54
One for one. 00:13:57
But they can be like. 00:13:59
2 inch caliper trees. It's based on canopy coverage. OK, what? What at maturity, canopy coverage would be right? 00:14:01
Yes, so they have. 00:14:11
On there I think it was. 00:14:13
9000 existing. 00:14:16
It's not detailed on here, but this is the replacement the 11,745 square feet. 00:14:21
It's like 9000. 00:14:27
200 or something. 00:14:29
Yeah, so there I mean it's. 00:14:31
It's taking some of those bigger trees that have a lot of canopy coverage. 00:14:32
And it will be more. 00:14:38
Dispersed into smaller trees. 00:14:39
Which eventually grow, but. 00:14:44
Yeah. 00:14:46
So you'll get smaller trees along your perimeter where you've got. 00:14:47
Some limited space. 00:14:51
A little bit bigger trees in some of these open spaces. 00:14:53
But yeah, just more dispersed. 00:14:56
Can be type coverage instead of these bigger central ones. 00:14:58
OK, Commissioners, anything else? 00:15:02
Angela, you look like you've got questions. Oh, I just, I don't see where the open space is on this bud. 00:15:10
So you know. 00:15:17
They're squeezing a lot of stuff in there. 00:15:20
Yeah, and that was just the difference of going from. 00:15:22
It's a. 00:15:26
It's zoned as multifamily so they are entitled to 12 units on there. 00:15:28
I think they're still within their total. 00:15:32
Lot coverage amount I think in our emits. 00:15:35
You can cover up to 60% of a lot. 00:15:37
Yeah, there was something on that landscaping plan that said that 40%. 00:15:41
Yeah. 00:15:45
Not. 00:15:47
Let me build on or. 00:15:48
But it doesn't count the planned Rd. 00:15:50
Counts as not building. 00:15:53
It's the road and the. 00:15:57
The road discount is building. 00:16:00
As. 00:16:03
We Scroll down to the bottom of that page, the yellow stuff. 00:16:06
Yeah, required 40% landscaping, not including tree canopy. 00:16:09
OK. 00:16:14
I think I'm just bothered by the clear intent to not. 00:16:15
Keep any trees. 00:16:18
Do you mean? 00:16:23
Where the buildings are going to be. 00:16:24
Anywhere. Uh. 00:16:25
They weren't wondering, though. 00:16:26
Oh well, no. 00:16:27
I mean. 00:16:29
Seems like they were not intending to. 00:16:30
Keep the existing trees at all. 00:16:33
Yeah. And that's you can discuss that with the applicant. 00:16:38
Yeah, just ask him. 00:16:42
And I think on this landscape, on the. 00:16:46
Don't show the one up front as being retained, but it is. 00:16:48
On their tree removal plan. 00:16:53
Which is. 00:16:57
I think it's this one. 00:16:58
OK. Any other questions? 00:17:11
Questions. 00:17:12
OK, do we need a break, Commissioners? 00:17:18
I'm good. We're ready to go. 00:17:22
OK. Well, in three, probably early though. 00:17:25
In 3 minutes we'll start then. So we have. 00:17:28
We have a three minute. 00:17:31
Break and then we'll start. 00:17:32
Right at six. 00:17:34
Ginger, will you read our? 00:17:39
We're happy to have our city staff, Carrie Marsh and Brad. 00:17:43
Christopherson legal counsel with us. 00:17:47
And would like to excuse commissioners. 00:17:50
Roach, Barrett and Font from our meeting tonight. 00:17:53
We have one item in front of us, but before we. 00:17:57
Hear that item? We have a statement that will be read by Commissioner Vilchinsky. 00:18:01
The City of Holiday Planning Commission is a volatile. 00:18:06
Volunteer Citizen. 00:18:09
Whose function is to review land use plans. 00:18:11
And other special studies making recommendations to the City Council. 00:18:14
On proposed zoning map and ordinance changes and approved conditional uses and subdivisions. 00:18:18
The Planning Commission does not initiate land use applications. 00:18:24
Rather, acts on applications as they are submitted. 00:18:28
Commissioners do not meet with applicants except at publicly noticed meetings. 00:18:31
Commissioners attempt to visit each property on the agenda. 00:18:37
Where the location, the nature of the neighborhood, existing structures and uses related to the proposed changes are noted. 00:18:41
Decisions are based on observations, recommendations from the professional planning staff. 00:18:48
The city's general plan zoning ordinances. 00:18:54
Other reports. 00:18:57
By all verbal and written comments. 00:18:59
And by evidence submitted. 00:19:01
All of which are part of public record. 00:19:03
Thank you. 00:19:06
We will. 00:19:07
Here tonight. 00:19:08
One item which is a site plan modification of a PUD. 00:19:11
The project is Highland Park, located at. 00:19:15
4880 S Highland Circle. 00:19:18
So let's see, tonight we will start with a. 00:19:23
Brief introduction from city staff and then we will hear from our applicant. 00:19:25
OK. 00:19:41
OK. So this is a previously approved planned unit development subdivision in the RM zone, which is residential multifamily. 00:19:43
At 4880 S Highland Circle. 00:19:54
Previous land use was a. 00:19:57
Home that was on the site that was used as a business for a long time. 00:20:00
And so this is a shift between or to that. 00:20:04
Or to have multifamily development. 00:20:09
Previously approved with I believe 11 townhomes on it. 00:20:12
The previous approval. 00:20:18
Included uh. 00:20:20
Umm, only trees to be removed that are impacted directly by building footprints and the road footprint that would be. 00:20:22
Installed for fire access. 00:20:30
As the applicant. 00:20:33
Did their tree assessment as they started working towards site development. 00:20:35
Their tree assessment involved. 00:20:39
Some additional trees that are outside of that previous approval. So that's what we're looking at today. 00:20:43
Primarily. 00:20:48
Trees that are on the West. 00:20:50
Side of the property perimeter and on the Northside of the property perimeter. 00:20:52
Umm, their landscape plan. 00:20:58
Did not. 00:21:03
Upload into. 00:21:04
The packet that was received, but I do have that. 00:21:06
Included SO. 00:21:10
We will review what is in their landscape plan. 00:21:11
Total lot coverage for the. 00:21:14
For the RM zone is 60% for buildings and roads with 40% landscaping. 00:21:17
So they have that detailed in their application here. 00:21:24
Also included. 00:21:27
The tree canopy replacement plan. 00:21:30
Is replacing I think it was roughly 9000, just over 9000 square feet of existing tree canopy that would be removed. 00:21:33
To 11,000 square feet of tree canopy that would be replaced. 00:21:42
So that's detailed on their site. This is the landscape plan that shows. 00:21:47
The new trees that would be planted, smaller trees obviously in this narrow arrow. 00:21:52
Area next to the road. 00:21:56
And along the backside with some bigger trees throughout. 00:21:58
The proposed removals. 00:22:02
Let's jump over to. 00:22:07
That one. 00:22:08
So the tree removals were detailed. 00:22:18
By the applicant and their application for the modification. 00:22:21
This tree was originally going to be removed, but they are leaving that one. It's a larger Willow tree that's up on the front. 00:22:26
East side of the property. 00:22:34
And uh. 00:22:36
The trees that are then affected. 00:22:37
By the roadway building footprints or these kind of interior. 00:22:41
Trees. Umm. 00:22:46
The ones that are outside of that area. 00:22:48
Are pretty close in. 00:22:50
This along this strip so that's. 00:22:52
Trees 987. 00:22:55
And six and then these two on the West perimeter, which is 4:00 and 5:00. 00:22:57
So those are good. 00:23:02
Additional trees that are outside of the original approval that the Commission would be looking at today. 00:23:03
The applicant provided a tree assessment by an arborist at Diamond Tree Experts. 00:23:10
They detailed all of the trees that are on the site. 00:23:17
And that was all included in the packet for. 00:23:21
For review. 00:23:24
I will have the applicant come up and they can go through the the trees that are on the site and some more details for you as 00:23:27
well. 00:23:30
Thank you. 00:23:35
If you can state your name and address even though we. 00:23:40
Have seen you before, that would be wonderful. Thank you. 00:23:43
Alec Moffett with Sequoia development addresses 9055 S. 00:23:45
1300 E Suite 104, Sandy, UT. 00:23:49
Do you want me to go through the trees 1 by 1? 00:23:54
Yeah, yeah. 00:23:58
Yeah, take us through. 00:23:59
All right, so. 00:24:01
I can see this one a little bit better. 00:24:02
Maybe Kerry, if you can zoom it a smidge. 00:24:05
Number one. 00:24:09
But #2 which was that Willow tree? 00:24:10
I believe you guys did a site visit today. 00:24:14
Two of us did OK. 00:24:17
As originally on the list, we took it off the list because we know in the past. 00:24:20
Pastimes and diamond trees stood up here. 00:24:25
That was a big one that you guys wanted to keep. 00:24:27
But it just keeps progressively getting worse and worse as far as health, especially with this hot summer we're having. 00:24:30
Well, it's on the list of the ones that we'll try to save. 00:24:36
But it's unlikely they'll survive through construction just. 00:24:40
By leaving it there. 00:24:43
So that one is a tough one. 00:24:47
Number one. 00:24:48
It's a group of pine trees that write. 00:24:49
Smack in the middle of the. 00:24:51
A building. 00:24:53
Same as three, if you want to go to four, we should work our way. Left 14. 00:24:55
It's a road Gentry in the middle of the road. 00:24:59
987 and six, those are all ones that are on the Northside that I. 00:25:02
I love and admire and I'm actually really sad that they died. 00:25:08
9-8 and seven are pretty much dead. 00:25:11
6 is 1 where it has a large root system that will be impacted severely by the road. 00:25:16
And we diversify the. 00:25:21
He does not. 00:25:24
See it? 00:25:25
Surviving. And so then it would just become. 00:25:25
A hazard to. 00:25:28
Anyone who lives there or parks? 00:25:29
On the other side, there's some. 00:25:31
Parking areas that could fall on the cars. 00:25:33
Umm, 12. 00:25:36
Brent Mill Road 11. 00:25:38
It's kind of 5050. 00:25:40
On exactly where it's going to be. 00:25:42
But it's so close to building footprint that it would. 00:25:44
Same thing. 00:25:47
If it's not taken half the tree, it's taken the root system. 00:25:48
And then four and five are ones that. 00:25:53
We kind of want to play by ear. 00:25:55
We want to get approval on them, but we want to approval to remove them, but we kind of want to save them. 00:25:56
That makes sense. 00:26:01
It's one of those where we'd love to save them. We want to keep as many trees as we can. 00:26:04
The reason why we bought this property is because of all the large mature trees. 00:26:08
It's just been unfortunate that over the past two years when this project has been on hold. 00:26:14
They have not gotten any water. 00:26:18
Or any care? 00:26:20
And their health is all. 00:26:21
Gotten really bad. 00:26:23
So that's where. 00:26:25
We're really only trying to take out trees. 00:26:26
Sick or dying? 00:26:28
Or going to be. 00:26:30
Adversely affected by construction by either being completely removed where a building is going to be, or the root system will. 00:26:31
And it'll end up killing the tree. 00:26:38
That is. 00:26:42
That's kind of tree by tree, so if you have any questions let me know. 00:26:44
OK. Brad, is it appropriate for us to ask questions now or should we wait until we've heard public comment and then? 00:26:47
Ask questions later. 00:26:55
OK. Commissioners, is there anyone that's got a question that they'd like to address to our applicant at this moment? 00:26:56
I do. 00:27:03
OK. Just out of curiosity, you talked about how you wanted to. 00:27:04
Hopefully keep these trees. 00:27:10
Umm, were you all the ones that took the irrigation system out? 00:27:12
Well, yeah, so we demoed, we demoed the home. 00:27:16
Which and we took the meters off all the water, so the water does not work there. 00:27:20
And right after we demoed it. 00:27:25
Interest rates skyrocketed. 00:27:27
Our initial plan. 00:27:30
It did not pencil. We had to put a stop on construction immediately. 00:27:32
Kind of felt out the market, I mean the market. 00:27:35
This was like and we bought property really expensive 2022. 00:27:37
2023 rolled in. 00:27:42
And it was right as we got everything approved and the market was just like homes were not moving. 00:27:44
Initially we wanted to price these pretty high. 00:27:50
And so we had. 00:27:52
You know, nicer finishes different construction. 00:27:53
Since then, we. 00:27:56
Spend, guys behind me spend. 00:27:57
Countless hours trying to. 00:27:59
Get the cost of these. 00:28:00
Homes down so they could be reasonably affordable too. 00:28:02
Knocking $200,000 off the purchase price. 00:28:06
And that's made it where we believe we can sell them in the. 00:28:10
And the project can move forward. 00:28:12
During that time, unfortunately, yes, no water. 00:28:14
Got to the trees of them what fell from the sky? 00:28:17
And we do live in a desert, so. 00:28:19
They were not having a good time. 00:28:21
OK. 00:28:24
But. 00:28:28
I mean, we are developers, we do like to improve the land we're on. 00:28:30
So the trees that we'll be replacing. 00:28:34
We are significantly increasing the canopy that's there now. 00:28:35
Or the canopy that was listed. 00:28:39
Was the canopy of them being healthy and full? 00:28:41
There's a lot of debt trees in there that have their canopies 0 right now, so that number could be much less. 00:28:45
But we're doing what was. 00:28:50
And we're improving it beyond what was. 00:28:52
OK. 00:28:55
Any other? 00:28:58
Thoughts at this point? 00:29:00
All right. Thank you. We appreciate your presentation. 00:29:03
Thank you. 00:29:05
This is an item with a public hearing and so at this point we will open the public hearing. 00:29:07
And invite members of the public that are here that would like to speak on this issue. 00:29:13
To come up you can take up to 3 minutes. 00:29:18
Please give your name and your address at the beginning. 00:29:22
State your points and. 00:29:27
If someone's made the same point that you're going to make. 00:29:29
Please don't. 00:29:32
We only need to hear it once and. 00:29:33
But we are happy to hear. 00:29:36
All the comments that the public has that are relevant to this issue, so we'll open that. 00:29:38
Public hearing right now. 00:29:43
My name is Joseph Amici. 00:29:53
My address is 4828 S Highland Circle, apartment 303. 00:29:55
I live in the Chateau Ferret. 00:30:00
Condominium complex which directly abuts this property to the north. 00:30:02
So you're just north of the property. 00:30:07
Yes, thank you. 00:30:09
Speaking in favor of these. 00:30:12
Proposed changes. Currently there are some. 00:30:13
Nice mature trees on this property, but it is. 00:30:17
Currently a unsightly pile of dirt. 00:30:20
Anything that can be done to expedite the building process, including the proposed changes with the replacement canopy trees I. 00:30:23
Would support. 00:30:31
As a side note. 00:30:33
I would like. 00:30:36
I would appreciate anything that the developer can do to. 00:30:37
Maintain the property. 00:30:41
In the interim before construction begins as it is. 00:30:43
Unsightly, full of garbage, and covered in abandoned traffic cones. Thank you. 00:30:46
OK. Thank you very much. 00:30:52
All right. 00:30:55
Do we have another member of the public who would like to speak? 00:30:56
OK. 00:31:04
Hi, Kevin Ludlow. 00:31:07
9055 S 1300 E Sweet. 00:31:09
104 I'm with Sequoia Development I. 00:31:12
The founder of Sequoia Development. 00:31:17
I appreciate the comments from the gentleman before it came to my attention that maybe you don't know who we are. 00:31:19
We love Holiday City. 00:31:26
I live in Holiday city. 00:31:28
We developed the. 00:31:31
Hyatt Place. 00:31:33
High place up there. 00:31:35
Bandits Restaurant. 00:31:37
The powerhouse ski shop. 00:31:39
So. 00:31:43
We're very familiar with holiday. We also did Holiday row right behind the the old Days hardware. 00:31:44
Some brownstone. 00:31:49
Residential. 00:31:51
Units that you may be seen in Hadley Pines just east of that so. 00:31:53
We love being in holiday. We appreciate. 00:31:57
Being here and. 00:32:01
Thanks for your consideration. 00:32:03
Thank you. 00:32:06
Thank you. 00:32:07
Any other members of the public? 00:32:11
All right. Well, we appreciate those of you that have spoken and at this point we will. 00:32:15
Go ahead and close the public hearing. 00:32:20
Let's just mention for the record, there was an e-mail submitted today that Carrie I believe will be included as part of the. 00:32:27
The public comment. 00:32:35
Yes, that will be. 00:32:37
Noted in our minutes. Just some general questions from. 00:32:40
From a resident nearby just. 00:32:46
Asking about what the plans were for the tree removal. 00:32:50
Perimeter trees and then drainage issues. 00:32:54
And happy to address those with that with that resident too. 00:32:57
OK. Thank you. 00:33:01
All right. So at this point, I think we're ready for some. 00:33:02
Discussion. 00:33:05
Between the Commissioners. 00:33:06
Can we ask the arborist a question though? Is the arborist here? 00:33:08
All right, well, why don't you ask Alec and just see what he knows? Alec, welcome back up. 00:33:14
Yeah, I I just want to make sure I understood that. 00:33:19
What's really going to happen to that Willow? 00:33:23
At the east side, the east, northeast side. 00:33:26
And then so didn't we specifically require that that stay in? 00:33:30
Are you asking now for that not to stay in? 00:33:35
I'm asking for approval to take it out if needed. 00:33:38
That's my request I know on. 00:33:41
On the application we crossed out. 00:33:43
But. 00:33:45
Going by and looking at it recently. 00:33:46
Since I submitted that. 00:33:48
And looking at our grading range plan. 00:33:50
It's just document we have to vote on. 00:33:53
Show the will not accurate. 00:33:56
I mean if I have to give them a little bike, keeping it. 00:33:58
And then we take it out in two years. Once dead then. 00:34:00
Are you asking about the landscape plan, Commissioner? Yeah, from the landscape plan, you know the. 00:34:05
One we have with the Big X there to make sure we didn't take that Willow tree out. 00:34:11
And now is the new. 00:34:16
Landscaping plan. 00:34:19
Does that include taking the Willow out? 00:34:21
Yes. So this landscaping plan does not show the Willow tree in it. So I think that. 00:34:25
If you approve this site plan. 00:34:29
Or the landscaping plan. 00:34:32
That, umm. 00:34:33
That accounts for that. 00:34:35
Removal. 00:34:37
I just wanted to clarify that because. 00:34:39
It's different again. 00:34:42
Yeah. And and we can, you can modify input conditions that you decide within the meeting that's there's space for that in your 00:34:45
conditions or findings. 00:34:49
Any modifications that you'd wish to make? 00:34:55
So since we didn't see the landscape plan before because it was too big or whatever it was for whatever reason. 00:34:57
If we wanted to say. 00:35:04
We want to, really. 00:35:07
Big tree there and we want it to start as a. 00:35:08
Big tree, and we don't want it to be a little one that's gonna grow to be a big tree. We want a big one to start. Can we do that? 00:35:11
How big? 00:35:17
Well, I'm not asking you, I'm asking Brad and Carrie if we can do that as a Commission. 00:35:19
As a condition. 00:35:23
I don't believe the tree ordinance talks about. 00:35:25
Big trees and it's not defined. I think it says. 00:35:27
The caliber. 00:35:30
If I remember correctly, carried. Maybe you have it more fresh in your mind. 00:35:31
Right, it's the replacement trees. 00:35:35
Need to be 1 1/2 inch caliper as a replacement. 00:35:37
But really, it's looking at the mature canopy size. 00:35:42
So as we were talking about in our work meeting, that can be dispersed into smaller trees or or a larger tree, but that. 00:35:45
It isn't a larger, more open space that. 00:35:53
Would be. 00:35:56
Appropriate for a larger tree. 00:35:57
But that is also the. 00:36:00
The developers. 00:36:02
The per personal choice. 00:36:03
Yes. 00:36:04
It also appears in the site plan that. 00:36:08
This is uh. 00:36:12
Here it's saying four and five might. 00:36:13
Be saved, but in the site plan they're not. 00:36:15
Those are not trees four and five, I don't think. 00:36:18
Those are different, so yeah. 00:36:22
But. 00:36:25
So the hope is that they would be saved. 00:36:27
Yeah, but we would be approving. 00:36:29
That they would. 00:36:31
So. 00:36:34
Commissioners, my recommendation is. 00:36:41
That you. 00:36:43
Consider this plan as if they're not going to be saved. 00:36:45
Yeah, then nobody's going to be disappointed. 00:36:48
And when we do save them, you guys will love us. 00:36:52
I mean that that that is one way to look at it. 00:36:57
Yeah. 00:36:59
So it appears that there are essentially no original trees. 00:37:01
Because the Willow. 00:37:06
Sounds like it's on its way up. 00:37:08
Yeah, this was a plant. I believe this was this landscape plan. I don't know if it included any of the actual existing trees. I 00:37:11
believe it was just a planting. 00:37:14
Plan like these are all trees that we're going to be adding. 00:37:18
So on top of the existing. 00:37:21
Canopy that's already there. 00:37:23
Be adding the 11,000 square feet. 00:37:24
But I don't think any of the trees are. 00:37:27
Slated for. 00:37:29
Continued to exist. 00:37:32
There's a lot of trees that are there that are not included. 00:37:36
Yeah, I mean just from. 00:37:40
Walking out there, there were a lot. There's there. 00:37:42
That weren't tagged or weren't spray painted. 00:37:45
When there's of this property is litter with trees. I mean that's why we bought it. 00:37:49
So there's, yeah. 00:37:54
Quite a bit of trees that are still there, plus these. 00:37:55
And the idea was it's gonna be a very private. 00:37:57
Secluded. 00:38:00
In the full community. 00:38:01
As many trees as we can pack on there. 00:38:03
Do we have a number of How many original trees are staying? 00:38:06
And again, I wish I knew. 00:38:11
I only count the ones that were leaving. I never counted the ones that were staying. 00:38:15
OK. 00:38:21
All right. Thoughts. 00:38:22
I mean, it sounds like we can't. 00:38:27
Mandate a really big tree, which is what my instinct would like. 00:38:30
But I recognize that. 00:38:35
That may not be a fair. 00:38:36
We can only do slash legal things to do, which seems a shame, but. 00:38:38
We do want Brad to be able to. 00:38:43
Goodwill of the developer. 00:38:45
That's right. 00:38:47
I think my thought is at this point. 00:38:52
The Arbor. 00:38:54
Our breasts. A wrist report. 00:38:56
Is not very. 00:38:59
Optimistic in terms of. 00:39:01
Of keeping any of these trees, certainly the pictures showed some. 00:39:03
Some or you know the ones listed. 00:39:08
Some serious. 00:39:10
And real health issues. 00:39:12
It just seems like. 00:39:15
That I think with some foresight that could have been prevented. 00:39:18
Knowing that these trees would need water for a couple of years, if I had a crystal ball I would have for sure. 00:39:23
Unfortunate lack of. 00:39:29
Planning plan. 00:39:30
It may suggest to us in the future that we require them to continue watering. 00:39:31
The trees continue water in the site attempting to train. I mean we take. 00:39:36
I want in a. 00:39:41
Piece of property that's irrigated. 00:39:42
You couldn't continue irrigating even if you took the building down. 00:39:45
That's something we ought to consider for. 00:39:49
I mean, we clearly can't come a thought this, a thought plan and say who does? 00:39:53
Many times and I've literally sat on a project with a fire hose. 00:39:58
Watering trees for hours on end. 00:40:02
Because we wanted to save trees. 00:40:04
Our company name is Sequoia Development. We love trees. 00:40:07
I've done it. The guys behind me have all sat in the lawn chair with a big old fire hose watering trees. 00:40:12
So right there would, yeah, if we would have known that this would keep getting dragged out on. 00:40:17
And on and on. 00:40:22
And we thought we were going to start in two months for like. 00:40:23
Two years now, yeah. 00:40:26
It's just, it was just. 00:40:27
Yeah. 00:40:29
Well, we'll cross our fingers for a fire hose the next go around. 00:40:31
And I can add that when you are dealing with demolition and you're having your power meters removed or your water meter removed, 00:40:36
there's no way to get water to the site. So. 00:40:41
Once the water meter is disconnected. 00:40:47
Then it makes it that much more difficult to get water to the site. 00:40:49
Yeah, yeah, yeah. 00:40:52
Yeah. 00:40:54
That'll make sense. It's. 00:40:56
Just the situation. 00:40:58
All right, Commissioners, are we ready to? 00:41:00
Let's start here. 00:41:06
You ready to move? 00:41:07
Towards something. 00:41:09
I, I think so I think at this point. 00:41:10
Approving the. 00:41:12
The new. 00:41:14
Or that you know this. 00:41:16
I don't know it is, but. 00:41:18
This site. 00:41:19
Plan makes sense, I think it. 00:41:21
You know, overtime. 00:41:24
Things will grow. 00:41:26
Are there any conditions that you would? 00:41:27
Be inclined to. 00:41:29
Suggest umm. 00:41:31
Besides, what's in the? 00:41:33
Report. 00:41:34
Noodle on that while we see if Commissioner Wilchinski has any thoughts. 00:41:37
Or Commissioner Cunningham. 00:41:42
That would be it, just. 00:41:43
I don't know if it. 00:41:45
Does this any good? 00:41:49
Try and encourage them to keep. 00:41:51
4:00 and 5:00. 00:41:53
I think we can encourage. 00:41:56
All we want. 00:41:58
And we can look really with really nice puppy dog eyes and. 00:41:59
Plead for 4:00 and 5:00. 00:42:04
Yeah, because it saves you money if you don't have to cut it down. 00:42:08
30 grown mature trees. We like that. 00:42:14
All right, Commissioner Cunningham, any other thoughts or conditions? 00:42:17
Commissioner Volcenski. 00:42:21
No, I'm just. 00:42:25
What kind of trees are we going to be putting in there? 00:42:27
Do we have? 00:42:31
Carrie, can you go through those with us since? 00:42:34
I can't read that. 00:42:37
Even with my. 00:42:40
OK. 00:42:42
So these junipers looked like they were on the South side of the property, on the backside of some townhomes. 00:42:44
OK, umm. 00:42:49
These are your bigger trees. 00:42:51
Here I believe. Let's see. 00:42:53
Well, bigger trees at 2 inch calipers, yeah. And then these are? 00:42:58
These are the smaller icons or. 00:43:03
Symbols are your. 00:43:05
Smaller shrubs that will then fill in. 00:43:07
Let's go back to the trees Are these. 00:43:12
2 inch. 00:43:15
Right, right, right. Oh yeah. 00:43:18
Yeah, yeah. 00:43:20
Yep. So it looks like a Maple. 00:43:21
This ginkgo should. 00:43:23
Is a great. 00:43:25
Large tree. 00:43:27
Slow growing, but they do really well in Utah. 00:43:29
And dry climates. 00:43:33
Crab Bowl. 00:43:35
And oak linen. So there's a lot of diversity in the trees, which I think is great. 00:43:36
And obviously they'll. 00:43:41
As a developer who has had experience with landscaping and all that there. 00:43:44
Making their. 00:43:49
Tree selections based off of this site too. 00:43:50
Is there? Is there turf? Is this speckly stuffed? 00:43:54
And landscaping wise, they can't do any grass areas that is less than 8 feet wide. 00:44:01
And that's in our. 00:44:07
Landscape Ordinance. 00:44:08
So these are always the scale on this. How big are those? 00:44:09
OK, so that's why. 00:44:12
Probably. 00:44:15
Mulch around plants and where it gets really narrow by the roadway. 00:44:15
Yeah, OK. 00:44:19
All right. 00:44:20
I mean they could consider no grass. 00:44:22
Think about it. 00:44:25
I don't know. I'm not sure we're ready to revisit this again. 00:44:27
All right. Well then, commissioners. 00:44:31
At this point. 00:44:35
I think we're ready to. 00:44:36
Might get the proverbial show on the road and. 00:44:40
And hopefully get some action going on this property soon. 00:44:43
Saved trees that are there. So do we have anyone who would be interested in? 00:44:47
Making a motion for us this evening. 00:44:53
I'd be happy to give me just a second and I'll pull it up and. 00:44:56
OK. 00:44:59
And we can't make it a condition, but we can make a really good suggestion. 00:45:03
Yay trees. OK. 00:45:08
I Commissioner Wilchinski motion for approval of a site amendment to the Highland Park plans unit development a residential. 00:45:14
11 Unit development within the RN zone located at 4880 S Highland Circle. 00:45:22
Finding that the proposal complies with the allowed. 00:45:28
Land uses. 00:45:31
For the RM zone. 00:45:33
No changes are being made to any of the previous approvals for the PUD. 00:45:35
Replacement tree canopy. 00:45:39
Coverage provides for the future preservation and enhancement of desirable site characteristics. 00:45:42
And we don't have any. 00:45:48
Umm, conditions. 00:45:52
Oh, with the following conditions. 00:45:53
That the tree. 00:45:56
Removals are only as designated. 00:45:58
That replacement trees to be planted as shown. 00:46:02
Significant deviations must be once again approved by the Planning Commission. 00:46:05
And although we're not going to call it a condition, we strongly urge you. 00:46:10
To try to keep. 00:46:15
Those trees, 4:00 and 5:00. 00:46:17
On that back into the property. 00:46:19
All right, Commissioner Bill Schinsky, do you want to include? 00:46:22
Two in that as well the front one. 00:46:25
The Willow, yes, also. 00:46:28
To that big Willow. 00:46:30
At the front of the property there. 00:46:32
If that, can it all be saved? Not a condition, but we would really like that saved if possible. 00:46:34
OK. I second the motion. 00:46:41
All right, thank you. We'll call for a vote, Commissioner Cunningham. 00:46:42
Aye, Commissioner Belchinski. 00:46:45
Hi, Commissioner Gong. 00:46:47
Aye, and Chair votes aye the motion. 00:46:49
Passes for your. 00:46:52
Site plan modification and. 00:46:53
Good luck to the you and the trees. 00:46:57
And we'll look for some action to happen there. 00:46:59
All right. Thank you very much. We appreciate the public being here and hopefully. 00:47:01
Have things happening? 00:47:07
There for you. 00:47:09
Our next scheduled meeting. 00:47:11
Kerry is when? 00:47:13
We will be holding our next meeting on July 15. 00:47:16
We'll have the Hinckley Subdivision PUD back at that time. 00:47:20
OK, so not next week. 00:47:25
I will be out of town on the 15th just. 00:47:27
Heads up. 00:47:29
Oh, 15. 00:47:30
Maybe I'll still be here. 00:47:33
I don't know, but OK, all right. And with I will also be out of town. 00:47:34
OK, and cannot join electronically. 00:47:39
OK, OK. 00:47:42
I will. 00:47:44
Survey the Commissioners before we. We will make sure that. 00:47:47
Will have at least 4 here. 00:47:51
If there's not going to be 4 here. 00:47:54
Possibly moving that to the. 00:47:58
Following week. 00:48:01
Umm, holding it on the first, which is going to be a little too soon for them. 00:48:02
Yeah, umm. 00:48:06
OK. All right. 00:48:07
Well, with that, we will adjourn our meeting this evening. Thank you. 00:48:09
We need a motion. 00:48:13
Aye, a motion to close. 00:48:15
We need a motion to do. We have a motion. We adjourn. 00:48:19
OK, all in favor. 00:48:22
Aye, a German, thank you. 00:48:24
Again, this train here straight and narrow. 00:48:27
This is it for. 00:48:31
Oh, this is it for Ginger. 00:48:33
